SUMMARY:Civil Litigation Basics 2023
DESCRIPTION:Who should attend: Junior civil litigators and experienced litigators seeking a refresher on key elements within civil litigation \nLearning level: Fundamental \nHere is a chance to experience top litigators presenting actual arguments to actual judges. This unique course is designed for several groups\, including: lawyers in the first two years of practice\, lawyers changing areas of practice\, and experienced lawyers who want a conceptual refresher on key elements within civil litigation. The program will also be of interest to law students and articled students. \nLaunched in 2021 as a Zoom webinar\, this innovative program takes a new approach\, as registrants will experience the entire life cycle of a case by watching counsel present the necessary arguments at various stages of a single fact pattern. \nThe first time through their presentation\, counsel will be making all the mistakes that drive judges crazy. Participants will try to identify all those errors in real time\, then listen as the judges and counsel debrief on what should have been done better. Counsel will then re-present the argument in the most effective manner. \nRegistrants will have an opportunity to test their skills against those of their colleagues\, as prizes will be awarded to those who can identify the most errors. This course will focus on providing registrants with the knowledge base they need to avoid falling into error themselves. \nPlease note: the practice-focused course materials will relate to the fact pattern\, the analysis of issues\, and error identification within each stage of the litigation process. If registration is closed or you have any questions\, please email knowledgenet@iapp.org.\n\n\n\n\nThis is a special joint event with the Calgary\, Edmonton\, Montréal\, St. John’s\, Toronto\, Vancouver and Victoria KnowledgeNet Chapters. \nTopic \nIndigenous Data Sovereignty and Data Governance \nIn her interim report titled “Sacred Responsibility: Searching for the Missing Children and Unmarked Burials”\, the Special Interlocutor identified 12 areas of common concern that created barriers to the recovery efforts to find the missing children and unmarked burials related to Indian Residential Schools. One of these areas was the need to affirm Indigenous Data Sovereignty. This was in addition to barriers caused by privacy laws developed or implemented without consulting Indigenous peoples. She urged Canadians not to be bystanders in the effort to overcome these barriers. \nWhat is Indigenous Data Sovereignty and how is it relevant to privacy? What does “not being a bystander” mean for privacy professionals and the role we play to ensure these rights\, which are enshrined in the UN Declaration on the Rights of Indigenous People\, are respected? \nIndigenous Data Sovereignty is the right of Indigenous people to own and govern data about their communities. It means Indigenous peoples are the stewards of data collection and the research done using their data.
