DESCRIPTION:The Intimate Partner Violence Intervention Court (IPVIC) is a specialized criminal court using an intervention-based approach to address the complex issues of intimate partner violence. Currently\, IPVIC operates in St. John’s and Stephenville but is expanding operations to central Newfoundland and will be housed in the Grand Falls – Windsor court. IPVIC uses a treatment-based approach intended to address the complex issue of intimate partner violence. The focus is on victim safety as well as emphasizing offender accountability and treatment. SUMMARY:Dispute Resolution Processes: A Sampler of the Spectrum
DESCRIPTION:In-Person: 3rd Floor\, Law Society Building\, 196-198 Water Street OR Online: Via Zoom \nSeminar Overview\nDispute resolution processes are now recognized as mainstream processes\, as opposed to alternative processes\, that take pressure off the courts and increase access to justice. Duties to use dispute resolution processes are incorporated into legislation and lawyers’ Codes of Ethics. DESCRIPTION:Seminar Overview \nIn his recent paper entitled “The Litigator and Mental Health”\, Chief Justice George R. Strathy noted the enhanced awareness of the importance of mental health in our society and the legal profession brought about by the global pandemic. Chief Justice Strathy has kindly agreed to speak to our membership about mental health and the work of litigators (though he notes that the content of his remarks his likely applicable to all areas of practice) following his retirement at the end of August 2022. Chief Justice Strathy will speak for approximately 40 minutes following which he will invite questions and commentary from attendees. This CPD event will be structured as a Zoom meeting rather than a webinar to promote a more engaging and personal environment for discussion. \nSeminar Presenter \nHonourable George R. Strathy\, Chief Justice of Ontario \nThe Honourable George R. Strathy was appointed to the Court of Appeal for Ontario on April 25\, 2013\, and was subsequently appointed as Chief Justice of Ontario and President of the Court of Appeal for Ontario on June 13\, 2014. \nFor the previous five years\, he served as a judge of the Superior Court of Justice in the Toronto Region\, where he presided over civil\, class action and criminal matters. He was appointed to the Ontario Superior Court of Justice on December 13\, 2007. \nChief Justice Strathy received a Bachelor of Arts from McGill University in 1970 and a Master of Arts from the University of Toronto in 1971. He studied law at the University of Toronto Faculty of Law where he received his LL.B. in 1974 and was awarded the Gold Medal. He was called to the Ontario Bar in 1976. \nIn practice\, he specialized in civil litigation\, with an emphasis on maritime and transportation law. He was active in a number of professional organizations\, including the Canadian Bar Association\, the Canadian Maritime Law Association and the Canadian Association of Maritime Arbitrators. He is the author of two books on maritime law\, as well as numerous papers and articles. \nChief Justice Strathy is married to Elyse Strathy. To meet these needs\, the British Columbia Law Institute is creating a guide to ‘Gender Diversity in Legal Writing: Pronouns\, Honorifics\, and Gender-Inclusive Techniques’ (Guide). \n\n\n\n\n\n\n\n\n\n\nThe Purpose of the Guide\nLegal writing comprises many forms: legislation\, court submissions\, opinion letters\, transactional writing (e.g.\, contracts\, wills)\, communications with clients and other lawyers\, legal memoranda\, legal texts and academic writing\, court forms\, judgments and decisions\, and other reports and papers. Ultimately\, the writer must choose the gender inclusive techniques needed for their audience and subject matter. The methods and tools explored in this publication give legal writers guidance to consider inclusivity in their writing. \nThe Guide: \n\nDefines terms and addresses common misconceptions associated with certain terminology (e.g. transgender\, not transgendered);\nOutlines techniques to reflect inclusivity and gender neutrality\, including review of honorifics\, greetings\, and pronouns;\nProvides examples of how to incorporate gender inclusivity into one’s own writing style; and\nProvides a list of resources for legal writers who want to learn more.\n\nThe Importance of Gender Diversity in Legal Writing\nGender-inclusive legal writing demonstrates a high level of professionalism and commitment to justice. It shows the writer’s commitment to the ideals underlying the legal profession and respect for their audience. \nInclusive language is important because it recognizes diversity and seeks to avoid discriminatory terminology. Inclusive language does not discourage a writer from discussing differences when it is important to do so. Instead\, it asks that a writer not exclude and marginalize people by drawing differences or using exclusionary language where differences are immaterial to the information being conveyed. More specifically\, it respects ability\, indigeneity\, race\, ethnicity\, gender\, gender identity\, sexual orientation\, age\, and other attributes of personal identity that have been used to discriminate against and marginalize persons with those attributes. \nThe Guide supports all legal writers in this goal- from long term practitioners seeking to learn a new way of writing\, to new lawyers beginning their careers with best practices. \nEmail About this Project\nbcli@bcli.org

Answer: cognitive biases. \n\n\n\nWe are designed to organize patterns in our complex\, information-filled world\, allowing us to be efficient and make rapid decisions with little mental effort. DESCRIPTION:The legal landscape in Canada raises difficult questions about managing substance use and abuse in the workplace. Arbitrators have considered numerous cannabis-related issues\, addressing employer policies regarding the use of medical cannabis by employees in safety-sensitive positions\, the obligation of employees to disclose their medical cannabis prescriptions\, and the broader legitimacy of workplace drug testing. These medical cannabis and drug testing cases provide guidance for workplace parties as the legal landscape continues to evolve. In this webinar\, experts will address recent developments surrounding substance use in the workplace\, including the following: \n\n\n\nHow have arbitrators’ approaches toward the use of medical cannabis in safety-sensitive positions evolved? How have arbitrators dealt with zero-tolerance policies for cannabis use in general? What lessons may be drawn in terms of how arbitrators may treat similar policies for decriminalized drugs or prescribed psychedelics?\nWhich drugs will be decriminalized in B.C. pursuant to the exemption under the Controlled Drugs and Substances Act?
