DESCRIPTION:The Intimate Partner Violence Intervention Court (IPVIC) is a specialized criminal court using an intervention-based approach to address the complex issues of intimate partner violence. Currently\, IPVIC operates in St. John’s and Stephenville but is expanding operations to central Newfoundland and will be housed in the Grand Falls – Windsor court. IPVIC uses a treatment-based approach intended to address the complex issue of intimate partner violence. The focus is on victim safety as well as emphasizing offender accountability and treatment. Duties to use dispute resolution processes are incorporated into legislation and lawyers’ Codes of Ethics. Strathy\, Chief Justice of Ontario \nThe Honourable George R. Strathy was appointed to the Court of Appeal for Ontario on April 25\, 2013\, and was subsequently appointed as Chief Justice of Ontario and President of the Court of Appeal for Ontario on June 13\, 2014. \nFor the previous five years\, he served as a judge of the Superior Court of Justice in the Toronto Region\, where he presided over civil\, class action and criminal matters. He was appointed to the Ontario Superior Court of Justice on December 13\, 2007. \nChief Justice Strathy received a Bachelor of Arts from McGill University in 1970 and a Master of Arts from the University of Toronto in 1971. He studied law at the University of Toronto Faculty of Law where he received his LL.B. in 1974 and was awarded the Gold Medal. He was called to the Ontario Bar in 1976. \nIn practice\, he specialized in civil litigation\, with an emphasis on maritime and transportation law. He was active in a number of professional organizations\, including the Canadian Bar Association\, the Canadian Maritime Law Association and the Canadian Association of Maritime Arbitrators. DESCRIPTION:Overview\nLike the law\, language and styles of writing evolve over time to meet the needs of new generations. One such shift is towards language that reflects a modern understanding of gender and gender identity. Inclusivity can no longer be limited to masculine and feminine but must be extended to include people who identify as non-binary\, agender\, two spirited\, or genderqueer. To meet these needs\, the British Columbia Law Institute is creating a guide to ‘Gender Diversity in Legal Writing: Pronouns\, Honorifics\, and Gender-Inclusive Techniques’ (Guide). \n\n\n\n\n\n\n\n\n\n\nThe Purpose of the Guide\nLegal writing comprises many forms: legislation\, court submissions\, opinion letters\, transactional writing (e.g.\, contracts\, wills)\, communications with clients and other lawyers\, legal memoranda\, legal texts and academic writing\, court forms\, judgments and decisions\, and other reports and papers. Ultimately\, the writer must choose the gender inclusive techniques needed for their audience and subject matter. The methods and tools explored in this publication give legal writers guidance to consider inclusivity in their writing. \nThe Guide: \n\nDefines terms and addresses common misconceptions associated with certain terminology (e.g. transgender\, not transgendered);\nOutlines techniques to reflect inclusivity and gender neutrality\, including review of honorifics\, greetings\, and pronouns;\nProvides examples of how to incorporate gender inclusivity into one’s own writing style; and\nProvides a list of resources for legal writers who want to learn more.\n\nThe Importance of Gender Diversity in Legal Writing\nGender-inclusive legal writing demonstrates a high level of professionalism and commitment to justice. It shows the writer’s commitment to the ideals underlying the legal profession and respect for their audience. \nInclusive language is important because it recognizes diversity and seeks to avoid discriminatory terminology. Inclusive language does not discourage a writer from discussing differences when it is important to do so. Instead\, it asks that a writer not exclude and marginalize people by drawing differences or using exclusionary language where differences are immaterial to the information being conveyed. These medical cannabis and drug testing cases provide guidance for workplace parties as the legal landscape continues to evolve. In this webinar\, experts will address recent developments surrounding substance use in the workplace\, including the following: \n\n\n\nHow have arbitrators’ approaches toward the use of medical cannabis in safety-sensitive positions evolved? DESCRIPTION:Eyewitness confidence was once characterized as a weak indicator of identification accuracy\, and is widely considered to be unreliable at trial. In recent years\, however\, a more positive view has emerged for eyewitness confidence at pretrial lineup procedures. \nResearch suggests a positive relation between confidence and accuracy\, and estimates from a recent analysis of the experimental literature suggest the suspect identification error rate is relatively low if confidence is high and the lineup procedure is pristine. This talk will delve into the methods of estimating error rates from lab data and consider their generalizability to eyewitness identification in criminal cases. \nThis webinar is the sixth in our Criminal Law Scholars Series (CLSS)\, which is being co-hosted by Courthouse Libraries BC and the Criminal Defence Advocacy Society. SUMMARY:Webinar – Making Parenting Plans: Helping Lawyers to Facilitate Resolution of Parenting Disputes (CPD 343): Law Society of Saskatchewan
DESCRIPTION:The Divorce Act amendments (Bill C-78) and Saskatchewan Children’s Law Act 2020\, reforms that came into effect in March 2021\, include provisions to encourage parents to make parenting plans (or agreements) that govern parenting time\, parental decision-making and other issues related to children. These plans may include aspirational statements about the parents’ expectations for themselves and their children. These plans\, or parts of them\, may be incorporated into court orders. Parenting plans are generally expected to evolve as children grow older and the circumstances of the children and their parents change\, giving rise to questions about how much detail to include in a parenting plan\, or the portion included in a court order. \nThis program will survey the child development literature\, legal principles\, and practical considerations that lawyers need to consider in making parenting plans\, including issues related to scheduling and parental decision-making\, as well as offering advice about negotiating plans in higher conflict cases. It will include reference to the Parenting Plan Guide and Template prepared by the Ontario Chapter of the Association of Family & Conciliation Courts (AFCC-O) and materials prepared the Department of Justice that can assist lawyers\, judges and parents in making parent plans\, as well providing templates for terms that may be included. \nPresenters: Nicholas Bala and Rachel Birnbaum \n$90.00\n\n\nQualifies for 1.0 CPD hour.
