SUMMARY:The Role of Cognitive Bias on Lawyers and the Practice of Law: Toronto Lawyers Association
DESCRIPTION:How do wrongful convictions really occur? How do opposing counsel have such opposing views of a matter? And why does the truth sometimes seem so difficult to distill? Answer: cognitive biases. \n\n\n\nWe are designed to organize patterns in our complex\, information-filled world\, allowing us to be efficient and make rapid decisions with little mental effort. Relying on these “mental shortcuts” has the potential to skew or undermine criminal investigations and lead to wrongful convictions\, and it even has the power to blind us from objectivity and fact. \nThis TLA special presentation will be led by David Rudolf\, criminal defense and civil rights lawyer featured in Netflix’s hit The Staircase and civil rights and criminal defense lawyer Sonya Pfeiffer. Sonya is also an award-winning journalist who covered the real-life trial behind The Staircase. The husband-wife duo will use a real-life case study from the trial of Michael Peterson (as depicted in The Staircase) to demonstrate how unconscious bias plays out in a complex and high-profile criminal trial. Throughout the program\, David and Sonya will engage the audience by asking questions and conducting polls. Participants are also encouraged to ask questions. \nJoin us in person or online. This unique and fascinating presentation will appeal to all lawyers\, regardless of practice area. \nWebsite\nwww.tlaonline.ca \nEmail\ndharrington@tlaonline.ca

SUMMARY:Going to Pot? Managing decriminalization\, medical cannabis\, and psychedelics: Nova Scotia Barristers Society
DESCRIPTION:The legal landscape in Canada raises difficult questions about managing substance use and abuse in the workplace. Arbitrators have considered numerous cannabis-related issues\, addressing employer policies regarding the use of medical cannabis by employees in safety-sensitive positions\, the obligation of employees to disclose their medical cannabis prescriptions\, and the broader legitimacy of workplace drug testing. These medical cannabis and drug testing cases provide guidance for workplace parties as the legal landscape continues to evolve. In this webinar\, experts will address recent developments surrounding substance use in the workplace\, including the following: \n\n\n\nHow have arbitrators’ approaches toward the use of medical cannabis in safety-sensitive positions evolved? How have arbitrators dealt with zero-tolerance policies for cannabis use in general? What lessons may be drawn in terms of how arbitrators may treat similar policies for decriminalized drugs or prescribed psychedelics?\nWhich drugs will be decriminalized in B.C. pursuant to the exemption under the Controlled Drugs and Substances Act? When will these changes take effect\, and for how long? What is the difference between decriminalization and legalization?\nUnder what circumstances may individuals be prescribed restricted drugs through Health Canada’s Special Access Program as a result of recent changes to the program?\nWhich substances may be prescribed?\nWhat implications are these changes expected to have for workplace parties? Drawing from experience surrounding medical cannabis and the legalization of recreational cannabis use\, should parties expect these changes to significantly affect the safety of the workplace?\nAre adjudicators more likely to find that workplace drug testing is justified as access to “hard” drugs and/or psychedelics expands?\nWhen are employees required to disclose use of medical cannabis or prescription psychedelics? Are employers entitled to information such as the type of drug\, method of consumption\, or frequency of use?\nAre adjudicators likely to uphold a termination or lengthy suspension when employees disclose after the fact that they are using prescribed cannabis or a restricted drug to treat a medical condition?\n\nWebsite\nlancasterhouse.com \nEmail\nBBurrows@lancasterhouse.com

SUMMARY:Regulatory Proceedings and Criminal Offences
DESCRIPTION:Conceptually\, there is a clear distinction between regulatory offences that do not require mens rea and criminal offences that do require mens rea. The regulated industries covered in this program will include: securities\, gaming\, taxation\, work safe\, environmental\, and government accountability. \nWho should attend: Crown counsel\, defence counsel\, corporate solicitors\, civil litigators\, and in-house counsel \nLaw Society of BC CPD Hours: 6 hours (this course will contain a minimum of 1 hour pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management) \nMonday\, November 14 | 9:00 am – 4:30 pm (PST) via webinar \nRegister here \n  \n  \n

SUMMARY:I’d never forget that face: Error rates for eyewitnesses: Courthouse Libraries BC
DESCRIPTION:Eyewitness confidence was once characterized as a weak indicator of identification accuracy\, and is widely considered to be unreliable at trial. In recent years\, however\, a more positive view has emerged for eyewitness confidence at pretrial lineup procedures. \nResearch suggests a positive relation between confidence and accuracy\, and estimates from a recent analysis of the experimental literature suggest the suspect identification error rate is relatively low if confidence is high and the lineup procedure is pristine. This talk will delve into the methods of estimating error rates from lab data and consider their generalizability to eyewitness identification in criminal cases. \nThis webinar is the sixth in our Criminal Law Scholars Series (CLSS)\, which is being co-hosted by Courthouse Libraries BC and the Criminal Defence Advocacy Society. Participants in this webinar may claim up to 1.5hrs of CPD with the Law Society of BC. \nPresenter: Dr. Ryan Fitzgerald\, Assistant Professor\, Department of Psychology\, Simon Fraser University\nModerator: Tamara Levy\, KC \n

SUMMARY:Webinar – Making Parenting Plans: Helping Lawyers to Facilitate Resolution of Parenting Disputes (CPD 343): Law Society of Saskatchewan
DESCRIPTION:The Divorce Act amendments (Bill C-78) and Saskatchewan Children’s Law Act 2020\, reforms that came into effect in March 2021\, include provisions to encourage parents to make parenting plans (or agreements) that govern parenting time\, parental decision-making and other issues related to children. These plans may include aspirational statements about the parents’ expectations for themselves and their children. These plans\, or parts of them\, may be incorporated into court orders. Parenting plans are generally expected to evolve as children grow older and the circumstances of the children and their parents change\, giving rise to questions about how much detail to include in a parenting plan\, or the portion included in a court order. \nThis program will survey the child development literature\, legal principles\, and practical considerations that lawyers need to consider in making parenting plans\, including issues related to scheduling and parental decision-making\, as well as offering advice about negotiating plans in higher conflict cases. It will include reference to the Parenting Plan Guide and Template prepared by the Ontario Chapter of the Association of Family & Conciliation Courts (AFCC-O) and materials prepared the Department of Justice that can assist lawyers\, judges and parents in making parent plans\, as well providing templates for terms that may be included. \nPresenters: Nicholas Bala and Rachel Birnbaum \n$90.00\n\n\nQualifies for 1.0 CPD hour.

SUMMARY:Mindless to Mindful Eating - Free Event
DESCRIPTION:We have developed a culture of mindless eating and drinking. We also mindlessly snack because we are under stress\, are simply bored\, and have developed bad habits. We aren’t thinking through the consequences of our eating habits and as a result chronic disease\, especially here in NL\, is on the rise. \nThe good news is that we can change this! We can become more mindful about what we are eating\, start to feel better almost immediately\, and set ourselves up for a healthier future. It is simply a mindset shift and it is totally within your power to do it! \nJoin Denise Follett in Mindless to Mindful Eating to learn how! \nRegister (this event is free of charge)\nEmail thebacknine709@gmail.com \nBiography\nDenise Follett was born in St. John’s and other than 5 years in Kansas City\, she has lived in St. John’s her entire life. \nShe graduated from MUN with a Commerce degree in 1995 and spent 25 years in the tax industry as either a tax auditor\, tax accountant\, or tax analyst.  In that 25 years\, she dealt with chronic pain due to a severe back injury and several car accidents.  Further\, she struggled with stress and it took a toll on her health. \nShe realized 3 years ago she needed a career change after a very terse discussion with her family doctor\, she enrolled in a certified health coaching program.  Part of the struggle with her chosen career was that  she always felt she wanted to help people.  As a health coach\, she has found her niche. She now works with women to change their habits as a sustainable approach to a healthy way of living with the hopes of preventing the chronic disease that plagues this province. The education she provides in her program is the reason why Bounce Innovation Foundation\, a collaboration of Eastern Health\, MUN\, and other agencies\, have partnered with her health coaching practice. \nAs a Certified Health Coach\, she is now living a very different life as she “walks the talk”. She has 3 grown children and spends most of her free time walking or hiking with her dog. \n

You get a chance to analyze what’s top of mind for your colleagues who are dealing with the same challenges and connect with them on how they respond. Parse through what you need to know about dealing with expert witnesses\, effectively handling the potential for any conflict or appearance of conflict of interest issues\, and learn how to clearly communicate with your clients. \n\nAnalyze and consider what constitutes fair dealing with self-reps when nuanced legal strategies are engaged\nLearn about caution and care to be taken in settlement negotiations\nConsider how to proceed when the Rules of Professional Conduct are silent on your issue

SUMMARY:CFLR Webinar Series
DESCRIPTION:The Inaugural CFLR Legal Research Webinar\nThe Canadian Foundation for Legal Research (“CFLR”) is pleased to present its inaugural research webinar. Professor Martha Bailey of the Faculty of Law\, Queen’s University will present her family law research topic\, Jurisdiction to Make Parenting Orders\, in an online format at noon EST on Tuesday\, December 13\, 2022. Professor Bailey will examine the case law surrounding the increasing preference for having courts in the subject children’s habitual place of residence take jurisdiction to make such orders and will comment on the benefits and problems resulting from that approach. \nTo register for Professor Bailey’s webinar\, simply click on this link and complete the registration form. \nBackground\nThe CFLR is a non-profit\, trustee-led organization that awards grant funds annually to legal scholars in Canada. It supports research that is of value to Canadian lawyers\, notaries\, and judges in their day-to-day work in the law and in the administration of justice. Applications seeking grant support for projects that emphasize access to justice\, and Indigenous and family law issues are especially encouraged. \nThe Webinar Series Initiative\nCommencing in December 2022\, the CFLR will begin presenting a series of one-hour webinars featuring legal researchers whose projects have recently received Foundation funding. The purpose of the series is to amplify the beneficial impact of CFLR research dollars on Canadian society by extending the reach of the findings of researchers whose work receives Foundation support to lawyers\, members of the judiciary and members of law faculties across Canada. \nThe first few CFLR webinars will be offered in English; webinars in the French language will be introduced very soon thereafter. Initially\, the webinars will be offered at no cost to registrants\, three times annually. All webinars will be recorded and made accessible online so that those who are unable to attend in real time can view the recordings at future dates. \nUpdates\nCheck the “Legal Research Webinar Series” drop-down menu on the CFLR home page for periodic updates\, including the dates and presenter details for future webinar offerings. \nCanadian Foundation of Legal Research\nadmin@cflr-fcrj.ca\n900 Greensbank Road\, Suite 436\nOttawa\, ON\nK2J 4P6\nwww.cflr-fcrj.ca
