SUMMARY:Sentencing Guidance in Canada: Conceptual Trends and Practical Problems
DESCRIPTION:This webinar will examine the Canadian approach to sentencing guidance (both legislative and appellate) as it has shaped up in recent years. The first part of the webinar will be more conceptual and historical\, exploring the uniqueness of the Canadian approach\, in comparative perspective\, and examining the idea of “individualized proportionality”\, which has developed as the guiding concept in the jurisprudence over the last 20 years. The second part of the webinar will turn to certain practical problems and issues that are in tension with this overall conceptual trend\, notably the role of starting points\, sentencing ranges\, and the interpretation of legislative “signals”. Building on the presenter’s current research\, attendees will be presented with an argument about the recalibration of sentencing ranges that appears available\, but has not yet been tested in courts.\n\n\nThis is the eighth webinar in the Criminal Law Scholar Series hosted by the Criminal Defense Advocacy Society and Courthouse Libraries BC. \nParticipants may claim 1.5 hours of CPD with LSBC. \nPresenter: Benjamin Berger\, Professor & York Research Chair in Pluralism and Public Law \nModerator: Tamara Levy\, KC \n\n\n\n4:30 PM (Vancouver)

SUMMARY:Newfoundland and Labrador Historical Society Lecture: The Mysterious Lambert de Boilieu by Robin McGrath
DESCRIPTION:Please join us online on Thursday\, March 30 at 7:30 p.m. (7:00 p.m. ADT) for this month’s NLHS lecture: \nThe Mysterious Lambert de Boilieu by Robin McGrath  \nRecollection of Labrador Life was first published in England in 1861 by Lambert de Boilieu\, then reprinted with editing and notes by Thomas F. Bredin by Ryerson Press in 1969. The work has been widely accepted as a memoir of life at Battle Harbour in the 1850s\, and is frequently cited in popular and academic articles. However\, research about the book and its author clearly indicated that no such person as de Boilieu existed by that name\, and many of the events described could not have happened in the 1850s\, if at all. Using various documents\, including court records\, Dr. Robin McGrath makes a tentative identification of the true author of the book and attempts to clarify his motivations for presenting fiction as fact. \nPlease register through this link: http://bit.ly/3ZFvQ7P   \nAfter registering\, you will receive an email with the link to the lecture. \nPresented by the Newfoundland & Labrador Historical Society \nUli Brown\nOffice Manager\nNewfoundland and Labrador Historical Society\nP.O. SUMMARY:Child Forensic Interviewing: Dos and Don'ts by The Criminal Defense Advocacy Society and Courthouse Libraries BC
DESCRIPTION:In the 1980s and 1990s there were several high-profile criminal cases involving child witnesses who reported heinous acts of abuse that could not have occurred as described by the children. Reports were elicited by aggressive and coercive interviewers who were committed to uncovering abuse. These cases spurred a tremendous amount of research on the strengths and limitations of children’s eyewitness memory. In turn\, this research was the foundation for the development of several child forensic interview protocols. Although there are many different protocols\, all the good ones follow a few best-practice principles. \nThe Criminal Defense Advocacy Society and Courthouse Libraries BC invite criminal law practitioners to join us for a webinar on Child Forensic Interviewing: Dos and Don’ts. This is the 10th webinar in the Criminal Law Scholar Series which will take place on Thursday\, April 27 from 12:30 – 2:00 PM.  Our presenter\, Professor Deborah Connolly will describe the principles of good child forensic interviews\, why they are important\, and possible consequences if the principles are not followed. \nParticipants may claim up to 1.5 hours of CPD with LSBC. \nPresented by Deborah Connolly\, Professor and Chair of the Department of Psychology at Simon Fraser University and moderated by Tamara Levy\, KC.

SUMMARY:Changing Professional Obligations for Family Law Lawyers Under the New Provisions of the Divorce Act
DESCRIPTION:In this presentation by the Atlantic Chapter of the National Alliance Project\, we will briefly review the Divorce Act amendments\, focusing on new duties placed on the parties\, judges\, and lawyers. In particular\, we will discuss how practicing lawyers must also follow the ethical duties set by their provincial or territorial regulator\, which is often consistent with the Federation of Law Societies of Canada Model Code of Professional Conduct. What lawyers may notice\, however\, is that all of these duties conflict and present additional challenges\, particularly when dealing with claims of family violence and the rights of children. We will review cases around the country interpreting the scope of the new duties on lawyers as well as the responses to the ethical issues lawyers may consider in the context of family violence cases. We will conclude by posing recommendations that may be considered to reconcile the legislated and ethical duties of the family law lawyer today.\n\n\n\n\nTo view the poster\, please [click here].

SUMMARY:Civil Litigation Basics 2023
DESCRIPTION:Learn from CLEBC’s team of litigation experts—not the school of hard knocks! \n\n\n\n\n\n\nThursday\, May 18\, 2023 (9:00 am – 3:00 pm)\nFriday\, May 19\, 2023 (9:00 am – 3:30 pm)\nVancouver location TBA\, or via webinar \nCan’t make the webinar or rebroadcasts?\nWant online CPD available 24/7?\n\nSubscribe to Courses On Demand\, our comprehensive online resource with 1\,500+ videos and 5\,400+ papers from CLEBC courses. This course will be added to Courses on Demand approximately 30 days from the original course date. \nWho should attend: Junior civil litigators and experienced litigators seeking a refresher on key elements within civil litigation \nLearning level: Fundamental \nHere is a chance to experience top litigators presenting actual arguments to actual judges. This unique course is designed for several groups\, including: lawyers in the first two years of practice\, lawyers changing areas of practice\, and experienced lawyers who want a conceptual refresher on key elements within civil litigation. The program will also be of interest to law students and articled students. \nLaunched in 2021 as a Zoom webinar\, this innovative program takes a new approach\, as registrants will experience the entire life cycle of a case by watching counsel present the necessary arguments at various stages of a single fact pattern. \nThe first time through their presentation\, counsel will be making all the mistakes that drive judges crazy. Participants will try to identify all those errors in real time\, then listen as the judges and counsel debrief on what should have been done better. Counsel will then re-present the argument in the most effective manner. \nRegistrants will have an opportunity to test their skills against those of their colleagues\, as prizes will be awarded to those who can identify the most errors. This course will focus on providing registrants with the knowledge base they need to avoid falling into error themselves. \nJoin us for the first in-person edition of this practical and practice-focused program! \nPlease note: the practice-focused course materials will relate to the fact pattern\, the analysis of issues\, and error identification within each stage of the litigation process. Registrants seeking a topic-by-topic review of the elements of civil litigation are directed to CLEBC’s Courses on Demand archive of Civil Litigation Basics 2018 and the associated reference materials. \nLaw Society of BC CPD Hours: 9 hours (this course will contain a minimum of 2 hours pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management) \nCourse Chairs\nThe Honourable Mr. Justice Ward K.
