SUMMARY:Changing Professional Obligations for Family Law Lawyers Under the New Provisions of the Divorce Act
DESCRIPTION:In this presentation by the Atlantic Chapter of the National Alliance Project\, we will briefly review the Divorce Act amendments\, focusing on new duties placed on the parties\, judges\, and lawyers. In particular\, we will discuss how practicing lawyers must also follow the ethical duties set by their provincial or territorial regulator\, which is often consistent with the Federation of Law Societies of Canada Model Code of Professional Conduct. What lawyers may notice\, however\, is that all of these duties conflict and present additional challenges\, particularly when dealing with claims of family violence and the rights of children. We will review cases around the country interpreting the scope of the new duties on lawyers as well as the responses to the ethical issues lawyers may consider in the context of family violence cases. We will conclude by posing recommendations that may be considered to reconcile the legislated and ethical duties of the family law lawyer today.\n\n\n\n\nTo view the poster\, please [click here].

This unique course is designed for several groups\, including: lawyers in the first two years of practice\, lawyers changing areas of practice\, and experienced lawyers who want a conceptual refresher on key elements within civil litigation. The program will also be of interest to law students and articled students. \nLaunched in 2021 as a Zoom webinar\, this innovative program takes a new approach\, as registrants will experience the entire life cycle of a case by watching counsel present the necessary arguments at various stages of a single fact pattern. \nThe first time through their presentation\, counsel will be making all the mistakes that drive judges crazy. Participants will try to identify all those errors in real time\, then listen as the judges and counsel debrief on what should have been done better. Counsel will then re-present the argument in the most effective manner. \nRegistrants will have an opportunity to test their skills against those of their colleagues\, as prizes will be awarded to those who can identify the most errors. This course will focus on providing registrants with the knowledge base they need to avoid falling into error themselves. \nJoin us for the first in-person edition of this practical and practice-focused program! \nPlease note: the practice-focused course materials will relate to the fact pattern\, the analysis of issues\, and error identification within each stage of the litigation process. Registrants seeking a topic-by-topic review of the elements of civil litigation are directed to CLEBC’s Courses on Demand archive of Civil Litigation Basics 2018 and the associated reference materials. \nLaw Society of BC CPD Hours: 9 hours (this course will contain a minimum of 2 hours pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management) \nCourse Chairs\nThe Honourable Mr. Justice Ward K. Topics will include succession planning issues; capital gains tax planning considerations\, including maximizing the principal residence exemption; succession timing alternatives; post-succession protections; and\, cottage sharing agreements. Along the way\, Peter will address the importance of being realistic\, the hard questions that needs to be asked about family members’ expectations and finances\, and what-if scenarios that\, without proper planning\, can lead to litigation. Don’t miss this unique opportunity to learn how you can help your clients navigate the cottage succession planning process and create an estate plan that successfully transitions a cherished retreat to the next generation\, despite the financial hurdles and inevitable family conflicts. \nMeet Your Presenter \nPeter Lillico is a partner in Lillico Bazuk Galloway Halka in Peterborough\, Ontario. Peter’s practice is concentrated in the areas of Estate Planning\, Business and Corporate Law\, and Real Estate\, with a unique expertise in cottage succession planning. An overwhelming 98% of our participants say they would recommend the program they have taken to their colleagues. If\, after having attended a program in its entirety\, you are not satisfied that the program has enhanced your understanding of the subject\, and you notify us of this in writing the same day\, we will give you a credit toward another program of comparable price. \nWho Should Attend \nThis program will appeal to lawyers whose practice includes estate planning and administration\, especially those who advise or act as executors and trustees. \nAbout the Program \nDifficult beneficiaries can create a long\, expensive and unpleasant estate administration. From feeling slighted to simply misunderstanding the process\, disgruntled beneficiaries can act out in any number of ways. Examples include inserting themselves into administration of the estate\, threatening to sue or contest the will\, withholding necessary information\, or harassing the executor. Fortunately\, many of the dynamics that lead to difficult beneficiaries can be anticipated and even avoided. In this entertaining and highly practical presentation\, veteran estate mediator and litigator Charles Ticker reveals the circumstances that give rise to difficult beneficiaries and offers important planning\, drafting and estate administration advice to avoid conflict and help protect the estate\, other beneficiaries\, and the executor from unnecessary drama and possible legal claims. Drawing on a blend of psychological research\, cases from his own practice and noted celebrity estates\, Charles describes typical troublesome or uncooperative beneficiary scenarios\, and shares defensive planning and administration strategies to head off common and not so common beneficiary complaints. By the end of the program\, you’ll be more aware of situations that contain heightened risk for difficult beneficiaries\, and you’ll have new tools to successfully plan for and manage difficult beneficiaries. Don’t miss this opportunity to get practical solutions to one of the biggest challenges that estate practitioners and executors face! \nMeet Your Presenter \nCharles B. Ticker is a Toronto based mediator and estate litigator with over 40 years of experience. He restricts his practice to estate litigation\, estate administration and mediation of estate disputes. Charles has appeared as counsel at all levels of Court in Ontario\, including the Court of Appeal. He is a member of the Canadian and Ontario Bar Association (Trusts and Estates and ADR sections)\, and the Society of Trust and Estate Practitioners. An active writer and presenter\, Charles has chaired and spoken at several legal conferences on estate issues and mediation. He publishes a blog “The Sibling Fight” which deals with sibling disputes in estate matters. He has produced a CD set entitled “How to Make the Most of your Mediation” and is the author of the book\, Bobby Gets Bubkes: Navigating the Sibling Estate Fight. A graduate of McGill University and Osgoode Hall Law School\, he is a past recipient of the Queen Elizabeth II Diamond Jubilee Medal. Charles is listed in Best Lawyers in Canada for Trusts and Estates. \n  \n“Very useful presentation with some good tips.” \n“Comprehensive program\, covered all of the ground promised.” \n“Some good suggestions and valuable information. SUMMARY:Strategic Privacy by Design\, by IAPP
DESCRIPTION:Privacy by Design: More than just a catchy phrase  \n“Privacy by design” has been part of the privacy practitioners’ vernacular for well over a decade\, but for many the phrase remains vague. In this talk\, the author of the IAPP CIPT textbook\, Strategic Privacy by Design\, will walk through the development of a hypothetical smart thermostat following the recently released Design Process Standard from the Institute of Operational Privacy Design. For many participants this will open up a new avenue of thinking about privacy beyond the laws\, principles and programmatic elements they are most familiar with and provide a level of concreteness to the concept beyond the broad to “build privacy in.”    \n12 – 1 p.m. EDT \n10 – 11 a.m. MDT

SUMMARY:Interim Remedies: Mastering the Pre-emptive Strike in High Stakes Litigation 2023
DESCRIPTION:More and more\, public and private litigants are resorting to early interim remedies to achieve litigation objectives. Commercial disputes see the use of Mareva\, Norwich\, and Anton Piller orders. Employers and business buyers use injunctions to enforce restrictions on services and businesses. Public organizations use freezing orders\, interim orders\, and forfeiture orders to intervene in industries. These parties recognize that without early intervention\, you can wind up with a hollow victory at the end of a long course of litigation. \nIn the dynamic world of 21st-century globally interconnected commerce\, the value of rapid early action with interim remedies is more important than ever. The early contest may become the only meaningful contest. \nThis course will review a range of interim remedies in a variety of operating contexts. The objective of this course is to strengthen the “blitz” toolkit that every modern commercial litigator should have at the ready. \nLaw Society of BC CPD Hours: 5 hours (this course will contain a minimum of 1 hour pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management). Please note: The CPD hours of the rebroadcast will either meet or exceed the CPD hours of the original live webinar course. \nCourse Chair\nChilwin Cheng — Ascendion Law\, Vancouver \n\n\n\nPricing\nEARLY BIRD \nRegister by May 23/23\nRegular Price\nAfter May 23/23\n\n\n\n\nLive Webinar\n$410   $369\n$479   $410\n\n\nLive Webinar Articled Student\n$238.50   $205\n$238.50   $205\n\n\n\n\n\n\nSummer Series 2023\nEARLY BIRD \nRegister by June 19/23\nRegular Price\nAfter June 19/23\n\n\n\n\nRebroadcast\n$371\n$412\n\n\nRebroadcast Articled Student\n$206\n$206\n\n\n\n\n\n\nAre you an Indigenous lawyer or community member?\nClick here for special pricing.\nDo you need financial assistance?\nClick here for bursary information.Experiencing financial hardship due to COVID-19?\nYou may be eligible for further reductions in our course prices.\nPlease contact Customer Service for more information.Registration includes an electronic copy of the reference materials.\n\n\n\nJust want the materials from the course?\nSubscribe to Online Course Materials and access 5\,400+ papers produced for CLEBC courses since 2001. \nWant to register for a course now\, but prefer a monthly payment plan?\nCheck out our Easy Pay Plan. \nCLEBC Program Lawyer*\nRaymond Lee\nrlee@cle.bc.ca\n*non-practising \n—Rebroadcast— \nSummer Series 2023: \n\nFriday\, July 21\, 2023\nFriday\, July 28\, 2023\n\nOn the rebroadcast date\, you will have until midnight of that rebroadcast date to access the course. If you miss the live program\, you can access the archive\, at your convenience\, for 60 days. \nWho Should Attend \nThis program will appeal to lawyers whose practice includes estate planning and administration\, especially those who advise or act as executors and trustees. \nAbout the Program \nEstate planning does not end when the testator passes away. This is especially true for owners of private companies\, including holding companies with rental properties and incorporated professionals. Decisions made after a shareholder’s death allow executors and beneficiaries to shape the way an estate is treated for tax purposes and how property is distributed. Most importantly\, post-mortem planning can mitigate double and triple taxation of private company shares on death. Failure to make the right post-mortem decisions in these situations can result in an estate paying more tax than is necessary\, leaving less for the beneficiaries and possibly exposing the executor to personal liability. This program\, featuring experienced tax and trusts practitioner Samantha Prasad\, will introduce non-tax specialists to some of the important tax reduction opportunities available when an individual dies owning shares of a private corporation – even if tax advisors were not consulted in the course of estate planning during the shareholder’s lifetime. The presentation will not make post-mortem planning less complicated\, but by using simple examples and plain language\, it will aim to make it understandable for the average practitioner. Don’t miss this chance to familiarize yourself with fundamental post-mortem planning choices and tools available to executors and beneficiaries to reduce taxation of private company shares on death and achieve efficient distributions. \nMeet Your Presenter \nSamantha Prasad is a Partner in the Tax Group of Minden Gross LLP. Her practice focuses on corporate\, international\, and high net worth tax planning\, with clients ranging from multi-national corporations to family business owners. Samantha co-authored the 3rd edition of Tax and Family Business Succession Planning. Additionally\, she is the co-editor of various other CCH Canadian Limited tax publications including the Canada Income Tax Guide\, Wealth Management Guide\, and Tax Planning for Small Business Guide\, and she is a regular contributor to TaxNotes (Wolters Kluwer) and is a Contributing Editor to The TaxLetter newsletters (MPL Communications). Samantha is also a frequent lecturer for professional and commercial organizations and has served as a guest speaker for the Osgoode Faculty of Law LLM (Corporate Taxation) program. Samantha is listed in Best Lawyers in Canada for Tax Law and in the Canadian Lexpert Directory as “Repeatedly Recommended” for Estate & Personal Tax Planning (Estate & Tax Planning).
