SUMMARY:Advising Complainants in Criminal Sexual Assault Cases
DESCRIPTION:Complainants of sexual assault face a daunting journey through the criminal law process. Assisting a complainant to understand the process\, what to expect\, and when they may be able to obtain legal representation through Legal Aid BC\, may help complainants decide whether to make a complaint and navigate the process. In this presentation Gwendoline Allison\, will share her experience as complainant’s counsel\, and discuss issues of publication bans\, third party records\, sexual history and privacy issues. This webinar is presented by Community Legal Assistance Society in partnership with Courthouse Libraries. The presentation will be aimed primarily at roster lawyers for CLAS’s new legal advice service for sexual assault. However\, other lawyers\, advocates and law students are welcome to attend. SUMMARY:AI Language Models for Law: Potential and Pitfalls by the Law Society of Newfoundland and Labrador Webinar
DESCRIPTION:Seminar Overview        \nWhen ChatGPT was released in late 2022\, large language models (LLMs) went from being a fringe pursuit to being a mainstream preoccupation. This presentation will address how LLMs may affect the practice of law and the pitfalls that the legal community could face in adapting to the new technology. It will give a primer on how LLMs work\, how useful they are at present\, and how this will affect the practice of law in the short to medium term. \nSeminar Presenters \nAmy Salyzyn  \nAmy Salyzyn is an Associate Professor at the Faculty of Law\, University of Ottawa. Professor Salyzyn has written extensively in the area of legal ethics\, lawyer regulation\, technology in legal service delivery and access to justice\, having now published over 20 articles in Canadian and international journals on these topics. She is also the author of three book chapters\, including a chapter on client confidentiality in Lawyers’ Ethics and Professional Regulation\, 4th ed. Professor Salyzyn is a regular legal ethics columnist for Slaw.ca. Prior to entering academia\, Professor Salyzyn received her J.S.D. and LL.M. from Yale Law School and her J.D. from the University of Toronto Law School\, where she was awarded the Dean’s Key upon graduation. Before coming to the University of Ottawa\, Professor Salyzyn also served as a judicial law clerk at the Court of Appeal for Ontario and practiced at a Toronto litigation boutique. She is currently the Board Chair for the Canadian Association for Legal Ethics. \nPeter Wills \nPeter Wills is a Doctoral Candidate at the Faculty of Law\, University of Oxford. His research focuses on the application of tort law doctrine to events caused by various forms of artificial intelligence\, including large language models (LLMs). He has taught Private International Law and a course on computer programming for lawyers at the Lincoln Alexander School of Law at Toronto Metropolitan University and has clerked at the Supreme Court of Canada for Justice Rowe and at the Court of Appeal for British Columbia for Chief Justice Bauman. This is especially true for owners of private companies\, including holding companies with rental properties and incorporated professionals. Decisions made after a shareholder’s death allow executors and beneficiaries to shape the way an estate is treated for tax purposes and how property is distributed. Most importantly\, post-mortem planning can mitigate double and triple taxation of private company shares on death. This seminar aims to equip lawyers with the necessary skills and strategies to navigate such situations with empathy\, sensitivity\, and professionalism. \nDuring this seminar\, you will learn how to identify and understand some common addictions and mental health issues that clients or other parties may experience. Our presenters will cover effective communication strategies that can help lawyers establish trust and rapport with individuals who are afflicted with addictions or mental health issues and highlight some of the resources that are available to help. The seminar will also provide guidance on how to effectively advocate for clients\, manage expectations\, and develop realistic goals and strategies for their cases. You will leave with a deeper understanding of these conditions and a greater ability to communicate\, advocate\, and navigate complex legal situations with empathy and professionalism. \nSeminar Presenters \nValerie Corcoran \nValerie Corcoran is the Coordinator for the Newfoundland and Labrador Drug Treatment Court (“DTC”) in St. John’s. She holds the dual role of being responsible for the continued oversight of the DTC and as the second member of the Drug Treatment Court Services treatment team. In 2023\, she will be responsible for the expansion of DTC’s to other regions of the province. \nHer experience in justice and specialty treatment courts was gained through her position with Legal Aid NL as Risk Assessment Officer with the Family Violence Intervention Court and through working within the federal and provincial prisons as Federal Prison Liaison with the John Howard Society of NL. \nIn addition to her experience in criminal justice\, Val holds a Master’s degree in Counselling Psychology with a certification in Clinical Traumatology. \nMark Gruchy \nMark Gruchy has practiced in Criminal Defense since his call in 2007. He currently works with the Newfoundland and Labrador Legal Aid Commission’s Special Defense Unit. His work there focuses on complex and serious criminal law matters. The unit handles all files involving death being carried by the NL Legal Aid Commission. \nHe is also a well-known mental health advocate and speaker. Mark was the President of the Canadian Mental Health Association – NL for six years\, which made him the longest standing President in that organization’s history. He has appeared in local and national media numerous times speaking on mental health subjects. He has spoken to a wide range of community groups ranging from the judiciary to inmates at Her Majesty’s Penitentiary. \nMark received the Newfoundland and Labrador Human Rights Commission Human Rights Award in 2016. He has also received the NLC President’s award for saving lives\, the National CMHA Consumer Involvement and Pottle Award\, and the 2017 Canadian Senate Sesquicentennial Award. \nMark has a history of lived experience with mental illness. Bipolar disorder is relatively common in Mark’s family. Mark’s father\, who had bipolar disorder\, suffered a massive hemorrhagic stroke when Mark was nine. Mark experienced an immediate and severe emotional change\, showing signs of depression and intermittent periods of emotional intensity which manifested as sleeplessness and energetic outbursts. Despite being a top performing student all the way though school\, Mark was forced to leave school as a youth due to mental illness having experienced a steadily decline in his ability to attend due to severe depression commencing around Grade 4\, culminating in his barely attending Grade 12 at all. \nAfter time outside of the school system\, he returned via a specialized adult basic education program for people with mental illnesses. Mark’s friends in this program experienced the full range of mental illnesses one normally thinks of. This program allowed Mark to complete three years of high school in one year. He then proceeded to perform very well in university\, ultimately becoming a Lord Beaverbrook Scholar in Law at the University of New Brunswick. \nPatricia Kirby \nPatricia Kirby (nee Carpenter) was called to the Bar in April 2000.  She spent the majority of her career in public law\, first as a Crown Attorney\, then as a Staff Solicitor/Area Director with Legal Aid NL\, before returning to private practice With Mills Pittman Twyne in February 2023 as the “World’s Oldest Junior Associate”.  Patricia is a strong advocate for mental health and autism awareness.  When not working\, she enjoys cooking\, baking\, spending time with her family\, and creating impudent cross-stitch samplers. \nRiley Moss \nRiley Moss was called to the NL bar in 2003. Since then\, she has practiced in all areas of Newfoundland and Labrador at all levels of court. She has many years’ experience practicing in interdisciplinary settings. She has additional training in mediation\, collaborative practice\, trauma-informed practice\, and restorative justice. For many years\, she practiced family law\, specializing in child protection. Through this work\, Ms. Moss has worked with many clients who experience mental health and addictions issues and are among the most vulnerable clients involved in the court system. Most recently\, Ms. Moss worked in the Legal Aid Mental Health Office\, as one of two Legal Aid lawyers who handle the clients of Drug Treatment Court and Mental Health Court\, as well as provincial Mental Health Care and Treatment Act reviews and the Federal Review Board (clients who are found unfit or not criminally responsible). She has just returned to private practice after fifteen years at Legal Aid NL. \nKara Pinksen \nKara Pinksen is the Addictions Specialist with the Newfoundland and Labrador Drug Treatment Court in St. John’s. She is a social worker with 20 years’ experience working in the field of addiction and mental health. While living in Fredericton NB\, she was involved in the development of their Opioid Treatment Program. Upon returning to NL in 2012\, Kara began work with Eastern Health doing addictions prevention work and community education. Join Gemma Hickey\, author and trans activist\, and Carey Majid\, KC from the Human Rights Commission to learn about these challenges and what we can do to make sure our legal services are as inclusive as possible. \nTopics will include: \n\nA lawyer’s ethical obligations\nTerminology – who are trans people and how do we talk about them respectfully?\nLegal issues related to client identification and verification\, privacy and confidentiality\, legal vs. chosen name/pronouns\, legal changes to identity documents\, same sex marriage\, identification in court/tribunals\, and human rights and the duty to accommodate.\n\nSeminar Presenters \nGemma Hickey \nA multi-awarding winning international author\, human rights advocate and global speaker from Newfoundland and Labrador\, Gemma Hickey’s advocacy has made headlines worldwide and changed the legal landscape of Canada expanding the rights\, dignity\, and equality of women\, the LBGTQ2+ community and survivors of religious institutional abuse. \nGemma became a well-known force for change in 2003\, when they travelled to Halifax to present a brief on same-sex marriage to the House of Commons Standing Committee on Justice and Human Rights. In 2004\, they co-lead the movement that legalized same-sex marriage in Canada as national President of Egale\, and in 2008 as national President of PFLAG Canada\, they lobbied Canadian Blood Services to end the gay blood ban. \nIn 2017\, their court application requesting a gender-neutral birth certificate spurred the Newfoundland and Labrador government to change its law\, and Gemma became the first person to receive a non-binary birth certificate and Passport. \nIn 2013\, Gemma founded the Pathways Foundation\, a non-profit organization that supports survivors of religious institutional abuse. To raise awareness and funds for the cause\, they walked across Newfoundland in July of 2015. In 2019\, they co-founded ACTS Canada (Advocates for Clergy Trauma Survivors) to support survivors nation-wide and represented Canadian clergy abuse survivors in Rome during the first ever Papal Summit on clergy sexual abuse. \nGemma’s physical and personal journey through gender transformation is the subject of the documentary\, Just Be Gemma. The film aired on CBC television and the Documentary Channel in 2017\, screened at various Canadian film festivals in 2018\, and made its international debut in 2019 in Japan. \nGemma’s memoir\, Almost Feral (Breakwater 2019) won Best Atlantic Published Book Award\, and the Margaret and John Savage First Book Award at the Atlantic Book Awards. In 2020 CBC Books listed Gemma as one of 24 Canadian writers to be featured on their Writers to Watch List and named\, Almost Feral as one of 40 Canadian books on the summer reading list. The book continues to receive rave reviews and was recently acquired by a publisher in Japan. \nGemma has consulted with all levels of government on gender equity\, inclusion and diversity and was invited to attend Prime Minister Justin Trudeau’s apology to the LGBTQ2+ community in 2017. In 2021\, because of their lobbying efforts to ban conversion therapy in Canada\, they were invited back to Ottawa by Justice Minister David Lametti to witness the tabling of the bill and speak alongside him on Parliament Hill. Gemma has also given addresses at universities\, and Canadian Embassies in different parts of the world. In Geneva\, they spoke about gender equity\, diversity and sexual violence before various countries and UN bodies. In Rome\, they spoke to Vatican officials on the importance of releasing all documents pertaining to residential schools. This fall\, they return to Rome and Geneva\, and finally The Hague\, to speak at the International Court of Justice on the rights of the child. \nTheir dedication to social justice and community engagement has led them to serve on the boards of diverse organizations\, including the St. John’s Status of Women’s Council\, Food Security Network\, Human Rights Association\, and Community Mediation Services. They were instrumental in the creation of two supportive housing facilities: Marguerite’s Place\, for women and The Tommy Sexton Centre for people living with HIV and AIDS. \nGemma is also passionate about the arts and has served on a range of volunteer boards such as the St. John’s International Women’s Film Festival\, Writer’s Alliance of NL\, Literary Arts Foundation\, Tramore Productions and Resource Centre for the Arts. \nAn emerging filmmaker\, they recently produced a short documentary entitled On The Fringe highlighting the plight of female sex workers during the pandemic in St. John’s. Upcoming documentaries include Road to Rome which follows clergy abuse survivors from different parts of the world on a pilgrimage to the Vatican and In the Name of the Father\, an auto-ethnographic take on the heteropatriarchy and coloniality within the Catholic Church. \nIn 2012 Gemma was recognized with a Queen’s Diamond Jubilee Medal for their contributions to human rights in Canada\, and in 2016\, named a Newfoundland and Labrador Human Rights Champion. Since 2010\, they have worked as the Executive Director of Artforce NL\, an arts-based charity that helps marginalized youth overcome socio-economic barriers. \nGemma is currently a Masters Candidate in Gender Studies at Memorial University. They live in St. John’s where they enjoy hiking the coastline and swimming in fresh water all year round. \nCarey Majid\, KC \nCarey Majid\, KC (she/her) is the Executive Director of the Newfoundland and Labrador Human Rights Commission. The Human Rights Commission is an independent at-arm’s length government agency that is responsible for promoting and protecting human rights in the province. \nCarey is a lawyer with over 20 years of experience. She practices exclusively in the area of human rights and administrative law. She was elected a Bencher of the Law Society of Newfoundland and Labrador in 2021 and appointed King’s Counsel in 2022. Carey is Chair of the Law Society’s Equity and Diversity Committee and also sits on the provincial Access to Justice Committee. SUMMARY:Critical Incident Group Debriefing
DESCRIPTION:Critical incidents are situations that occur outside of our normal frame of reference and challenge us to understand and cope with what has happened. Critical Incident Group Debriefing (CIGD) is a short-term group intervention process that focuses on an immediate event. CIGD is one of several methods that may be utilized to lessen the likelihood of people experiencing symptoms of trauma and stress after a critical incident. This group debriefing process provides a place for participants to talk and share experiences\, and for the facilitator to teach and provide information about the impact of critical incidents.
