SUMMARY:Dramatic Reading of Leviathan Unbound
DESCRIPTION:Join Us for a Dramatic Reading of Leviathan Unbound\n\n\n\n\n\n\n\n\n\nLocation: LSPU Hall\nAdmission: Free and open to the public \nThe S.S. Daisy Legal History Committee invites you to a dramatic reading of Leviathan Unbound: Currie et al. v. Macdonald et al.\, a play by John Joy. This compelling work revisits a pivotal 1948 legal case in which six members of Newfoundland’s House of Assembly and Legislative Council challenged the legitimacy of the National Convention and confederation referendum. This historic case ultimately sought a court declaration deeming the actions of the Governor and Commissioners of Government unconstitutional. \nThis production\, co-produced and co-directed by Alex Jessome\, provides a unique glimpse into a crucial moment in Newfoundland’s legal history. Don’t miss the opportunity to experience this powerful story! \n\nView the poster for Leviathan Unbound here

SUMMARY:IPV Protecting Victims from Cybercrime: Practical and Legal Next Steps
DESCRIPTION:The Commonwealth Lawyers Association Family Law Committee in partnership with the International Academy of Family Lawyers presents a webinar on “IPV Protecting Victims from Cybercrime: Practical and Legal Next Steps” \n\n\nThe Commonwealth Lawyers Association and International Academy of Family Lawyers invites you to join us for webinar focusing on “IPV Protecting Victims from Cybercrime: Practical and Legal Next Steps”. \nRegister here to attend \nFollowing on from the webinar “Cybercrime in the intimate partner and honour-based abuse contexts: signs and preventative strategies”\, which took place on 17th September 2024. Some of the key issues which were discussed\, were the differing legal landscapes with patterns and themes identified such as how anonymity allows perpetrators to hide behind the dark web\, how to shift the stigma to empower the victims\, the  limitations of the application of available legislation. \nAs social media is a popular means of communication and virtual platforms such as Facebook has a prominent presence globally. In terms of pitfalls\, a similar premise applies in amongst many commonwealth jurisdictions\, and global statistics show that Facebook reflects the highest number of online abuse of all social networking sites[i]. The negative impact of social media abuse\, as with most forms of gender-based abuse\, is that it has a disproportionate impact on women and girls\, as a result of which Amnesty has labelled online violence and abuse of women a wider problem than that of discrimination and violence against women offline.[ii] \nThe purpose of this webinar is to have a discussion about practical next steps and solutions. The focus will be on the legal and social landscape of various jurisdictions\, namely England and Wales\, Caribbean\, Malaysia and Zambia. The speakers will discuss practical and legal solutions on ways in which cyber abuse as a form of gender-based abuse can be tackled in their respective jurisdictions. \n[1] Statista. 2017. SUMMARY:Interplay of Psychology\, Neuroscience and Conflict in Mediation
DESCRIPTION:The Commonwealth Lawyers Association invites you to join us for a mediation guest lecture series for the FINAL episode 6/6 takes place with A. J. Jawad\, Senior Mediator\, Trainer and Arbitrator. \nRegister here to attend \nMediation operates on a paradigm of conflict resolution unlike litigation or arbitration that operate on the paradigm of dispute adjudication. Mediation perceives conflict as a problem arising from the different perspectives and perceptions of the parties to the conflict and the emotions that get triggered due to such differing perceptions. It is therefore important for a mediator to understand these drivers of the conflict and move the parties to a position of understanding each others perspective. Therefore understanding the interplay of psychology\, neuroscience and conflict in mediation forms an integral part of mediation training. \nTIME: \n8.00 am Jamaica\n8.00 am The Bahamas\n9.00 am Dominica / Trinidad and Tobago / St Vincent and the Grenadines\n1.00 pm United Kingdom\n2.00 pm Nigeria\n3.00 pm Zambia\n6.30 pm India\n9.00 pm Singapore / Malaysia / Hong Kong\n11.00 pm PNG \nPanelist \n\nA. SUMMARY:Mental Health Awareness and Support
DESCRIPTION:Mental health concerns will directly impact one in every five people. The remaining four will know a friend\, family member\, coworker\, or acquaintance that struggles with their mental health. SUMMARY:Drafting User-Friendly Emails and Documents
DESCRIPTION:Please note: This course will not be added to Courses on Demand. Courses involving professional speakers and skills-based workshops generally do not get added to Courses on Demand.\n\n\n\n\n\n\nWho should attend: This course is designed for lawyers who wish to take their writing “from good to great.” It is not a remedial course. Given the complex nature of legal subjects\, it is challenging to formulate smooth prose. This course will offer concrete strategies to deliver information in a user-friendly format. \nLearning level: All levels \nModule I: Balancing Conciseness with Readability \nAt the beginning of this course\, we will analyze how lawyers can reduce the length of their writing. We will focus on deleting words\, reducing syllables\, and shortening phrases. \nThen\, this course will form a bridge between conciseness and readability by examining the rare situations in which including an extra word can assist with absorption. For example\, we will tackle raging debates—among writing nerds—over the word “that” and the phrase “in order to”. \nNext\, this course will dive further into readability by demonstrating how lawyers can deliver complex information in a smooth fashion. We will address techniques such as: \n\nunderstanding the limits of a reader’s working memory\nknowing the optimal length of sentences\ndelivering familiar information before unfamiliar information\ndeciding whether to reference an earlier part of a legal document or repeat the information explicitly\nchoosing whether to refer to individuals and corporations by their names or by other labels\, such as “appellant\,” “Holdco\,” “trustee\,” etc.\n\nModule II: Email Etiquette \nThis part of the course will focus on eliciting positive responses when communicating by email. \nThrough an interactive discussion\, attendees will be able to ask questions and share their own opinions about the best practices for yielding prompt\, positive replies to emails. Relevant topics will include: \n\nemail length\nresponse time\nsubject lines\ntone and formality\ncopying\npleasantries (such as\, “I hope all is well.”)\nanything else relevant to email dos and don’ts\n\nModule III: Persuasion \nFinally\, this course will explore persuasion in legal writing. \nWriting persuasively is an elusive concept because all lawyers know that it’s important\, but it is often defined as the totality of clear\, concise\, and grammatically correct writing. This definition must be incomplete\, since persuasion surely has its own unique qualities beyond clarity\, conciseness\, and correctness. \nWe will take a closer look at the ingredients of persuasion in legal writing\, and\, interestingly\, we will find ourselves debating whether persuasion is truly a writing challenge or\, in fact\, a substantive legal challenge. \nYou may also be interested in Clear and Credible Legal Writing on Wednesday\, October 30\, 2024. \nCourse Instructor\nRyan Standil — Write To Excite\, Toronto

SUMMARY:Mediation & Arbitration
DESCRIPTION:COMPLEMENTARY PRESENTATION \nRegister Here \nA family dispute resolution service that provides for mediation to resolve concerns with the option to move to arbitration for concerns that are not settled. \nThis webinar is for family law professionals who are looking at family dispute resolution options for their practice and families. \nHear how Mediation Arbitration could be a practice option that grows your practice while providing families with options outside of court. Increasingly\, we are seeing professionals in the region who are offering FDR processes as part of the suite of services they offer clients. \nMediation-arbitration (med-arb) combines two FDR processes. In mediation\, the parties work with the mediator who helps them negotiate terms of a settlement. Any concerns not resolved through mediation\, continue through to arbitration where the trained arbitrator hears evidence from both of the parties and makes decisions in the form of an award. \nTom Dart was called to the bar in 1976.  In the early stages of his career\, he practiced as a criminal lawyer\, a civil litigation lawyer and a family law lawyer.  He now practices only in the area of family law and alternative dispute resolution. SUMMARY:Handling the Difficult Employee
DESCRIPTION:Duration: 60 Minutes\nWebinar Id: 23400\n\n\n\n\n\n\n\n\nUnlimited Attendees: Any number of participants \nRecorded Version: Unlimited viewing for 6 months (Access information will be emailed 24 hours after the completion of live webinar) \n\n\n\nOverview:\nJust about every workplace has at least one difficult employee. \nIn this webinar\, we will identify the various types of difficult employees and various strategies that can be used to deal with them. Difficult employees can have an adverse impact on the productivity and morale of the workplace. SUMMARY:Peace jurisprudence and constitutional reform - incorporating Mediation Principles into Supreme Law
DESCRIPTION:The Commonwealth Lawyers Association invites you to join them for a mediation guest lecture series as episode 4 takes place with Justice Vasheist V Kokaram JA. \nRegister here to attend \nConstitutions must respond to developing norms of shared regional and international values of human rights and the rule of law. It is a visioning of a community of human beings collaborating to create an optimum environment for the celebration of our human dignity\, flourishing of our human potential\, sustainability of our human development and preservation of our specie. But what all of our aspirations involved in constitutionalism cannot avoid is conflict which inevitably emerges in whatever political systems are designed. In my presentation I explore our baseline jurisprudential approach to the management of conflict and demonstrate the relevance of the DNA of mediation to develop new constitutional values and  our instincts for peace. Can positive peace outcomes be achieved\, reinforced and sustained when we reorient our constitutional frameworks to a “mediative” and positive approach to conflict? What approaches to peacebuilding can be embedded within our task of constitutional reform to avoid conflict\, minimise its occurrence and harness its positive lessons? \nDate: 31st October 2024\n \nTIME: \n8.00 am Jamaica\n8.00 am The Bahamas\n9.00 am Dominica / Trinidad and Tobago / St Vincent and the Grenadines\n1.00 pm United Kingdom\n2.00 pm Nigeria\n3.00 pm Zambia\n6.30 pm India\n9.00 pm Singapore / Malaysia / Hong Kong\n11.00 pm PNG \nRegister here to attend \nPanelist \n\nJustice Vasheist V Kokaram JA\n\nEpisode 5 – 7th November –  Mediation Advocacy: The Ignored Middle Child?\nEpisode 6 – 14th November – Interplay of Psychology\, Neuroscience and Conflict in Mediation \n\n+ Google Calendar+ iCal Export\n\n\n\nOrganiser\n\nCommonwealth Lawyers Association

SUMMARY:Mediating High Conflict Disputes
DESCRIPTION:Limited enrolment for in-person registrations. Register early to avoid disappointment!\n\n\n\n\n\n\nPlease note: This course will not be added to Courses on Demand. Courses involving professional speakers and skills-based workshops generally do not get added to Courses on Demand. \nWho should attend: All mediators and those acting as counsel in mediations \nLearning level: Intermediate \nHave your best mediation skills failed with some clients? And then felt that despite your best efforts\, some mediations are impossible? \nIt’s likely that you may have been mediating with one or more parties with a high conflict personality\, making it a high conflict dispute. \nHigh conflict disputes are different. They often involve one or more individuals with a pattern of high conflict behaviour\, characterized by all-or-nothing thinking\, unmanaged emotions\, extreme behaviour\, and preoccupation with blaming others. \nIn this one-day workshop\, instructor Michael Lomax will provide a new approach to mediating such disputes: New Ways for Mediation. This approach includes several paradigm shifts from ordinary mediation by not relying on insight\, expression of emotions\, or discussions of the past. \nInstead\, this method focuses on teaching clients four simple skills to use within a simple structure that keeps them focused on problem-solving solutions and away from venting\, reworking the past\, extreme demands\, rigid positions\, and other self-defeating behaviours. \nThe skills for mediators are also simple and less stressful\, so that they serve primarily as a guide and source of information throughout the process. Some or all of the tips and tools of this method can be used with any mediation. \nAfter this training\, you will: \n\nhave the necessary skills for handling high conflict mediations\nexperience increased confidence as you settle into the specific structure of this method\nlet go of feeling responsible for the outcome\n\nPrerequisite: It is recommended that you have already taken some introductory training in Dealing with High Conflict Behaviours with Michael Lomax or the High Conflict Institute. \nCourse Instructor\nMichael J. Lomax\, JD — Michael Lomax CDR Inc.\, Victoria

However\, as with most legal issues\, there is no certainty that these contracts will be upheld. Judicial consideration has shown that domestic contracts are vulnerable to being set aside or varied in the future\, where equity can be argued. So\, what can drafting lawyers do to help ensure a testator’s wishes have the intended effected? This presentation by experienced wills and estates and family law mediator and litigator Gary Kirk will provide prophylactic steps to help ensure the integrity of domestic contracts and minimize the need to take remedial steps – the effectiveness of which is uncertain – or litigate the validity of a contract after the fact. By the end of the program\, you will better understand: \n\nthe factors that affect judicial consideration of domestic contracts and testamentary freedom\nthe risks of claims and court intervention\nfundamental safeguards that should accompany domestic contracts involving inheritance waivers\n\nYour clients’ confidence and certainty in their testamentary plans will increase if appropriate and prudent steps are taken when executing a domestic contract. Attend this program and learn what you can do to help preserve the function and intent of these contracts. \n\n\nMeet Your Presenter\n\nGary Kirk has been practicing law for more than 20 years and is the Managing Partner of Kirk Montoute Dawson LLP in Calgary\, Alberta.
