SUMMARY:Estate Planning for Beneficiaries with a Disability
DESCRIPTION:Who Should Attend\nNew and experienced estate planners will benefit from attending this program. \n\n\nAbout the Program\nCreating an estate plan for a family that includes a person with a disability raises special issues and considerations outside of the typical estate planning engagement. Families must make careful choices about estate planning strategies and tools\, taking into consideration their loved one’s unique circumstances and anticipated needs. This program will introduce estates practitioners to the opportunities\, challenges and emotions unique to planning for a person with a disability. Noted disability lawyer Brendon Pooran will review the resources\, funding\, documents and structures involved in disability planning and share practical advice to help ensure the financial\, living\, and health requirements of individuals with disabilities continue to be met after a caregiver or provider passes away. In addition\, Brendon will discuss common planning errors that can reduce the financial support available to beneficiaries with a disability and expose them to financial exploitation. Topics include: \n\nPlanning tools\, including Henson Trusts\nAppointing decision-makers\nCreating supports to assist with incapacity issues\nAddressing risks of susceptibility\n\nDon’t miss this chance to learn how you can help give families peace of mind that their loved one’s needs will continue to be met\, even when a family member is no longer there to organize and advocate on their behalf. \n\n\nMeet Your Presenter\n\nBrendon Pooran has been involved with various disability organizations as a member\, volunteer\, employee or director for most of his life. He created PooranLaw to provide support to this community and to influence disability law and policy across Canada. Prior to founding PooranLaw\, Brendon worked for a large multi-national law firm where he practised labour and employment law and at a boutique law firm that specialized in accessibility issues. Before entering the legal profession\, Brendon spent several years as a management consultant where he regularly provided strategic advice to human services clients in the United States. In addition to practising law\, Brendon teaches Critical Disability Law at York University\, is the Past-President of Community Living York South and is a founding director of both PLAN Toronto (now Partners for Planning) and Microboards Ontario. He is a former Senior Lawyer Member on the Ontario Consent and Capacity Board.

Don’t miss this fall’s Legal Research 2023 — a course that will take a deep dive into the current state of legal research and where it’s headed. We’re proud to be teaming up with the BC Law Institute to bring this program both to Vancouver and via webinar on Tuesday\, October 17. So be sure to save the date! \nIncreasingly\, the practice of law is influenced in various ways by technology and AI. The rise of data and the way it is managed by technology impacts the role of lawyers and the judiciary. Governments are taking steps to respond to the impacts of AI and the legal profession needs to understand how it affects their work. \nThis intermediate level course will focus on how AI and emerging technologies impact various aspects of the legal research method\, the products of legal research\, and the way in which those products are received by their judicial audience. \nWith a wide array of legal research resources now available\, it can be challenging to know which are the most efficient at supporting different steps in the process. You can expect to gain a better understanding of how AI has been integrated into various legal research tools and how it can help or hinder your work. \nLearn some of the pitfalls to watch for when relying on AI-supported research and how to ensure your submissions are based on a solid foundation. Discover how emerging technologies are transforming approaches to Aboriginal rights and Indigenous litigation. Hear from members of the judiciary about recent legal research trends or habits that have made an impression on them. \nExperienced and innovative legal researchers will share tips for combining traditional strategies with creative use of technology and design thinking to successfully solve even the most challenging research problems. \nWho should attend: This course will be of interest to all lawyers and their support staff who have occasion to assist with legal research

SUMMARY:Recommendations\, innovations\, and law reform to address the intimate partner violence epidemic
DESCRIPTION:The Law Commission of Ontario (LCO) invites you to a free one-hour webinar addressing intimate partner violence and law reform in Ontario. This is the first of two LCO webinars during Access to Justice Week 2023. \nTitled ‘Recommendations\, innovations\, and law reform to address the intimate partner violence epidemic\,‘ the session will consider reforms to Ontario’s justice system to improve legal protections and services for survivors of intimate partner violence (IPV). The topic is a long-standing and urgent access to justice issue in Ontario and across Canada. \nThe inadequacy of the justice system’s response to IPV and other gender-based violence has been criticized for many years\, culminating earlier this year in calls for provincial and federal governments to declare and address the IPV epidemic. Recent inquests\, inquiries\, and legislative efforts following mass casualties and femicides have highlighted the need for – and complexity of – justice system reforms. \nThe session will bring together experts to discuss potential IPV reforms\, legal issues\, practical challenges\, and best practices. Audience members will learn about: \n\nThe scope and scale of IPV;\nThe legal needs and access to justice challenges for survivors of IPV;\nThe strengths and weaknesses of current laws and practices;\nRecommendations from recent inquests and inquiries (the Culleton\, Kuzyk\, and Warmerdam Inquest in Renfrew County\, Ontario\, and the Mass Casualty Commission in Nova Scotia); and\nPotential reforms to Ontario’s protection order regime.\n\nThis session will be interesting to many stakeholders\, including individuals and organizations concerned with IPV and gender-based violence; family justice; criminal justice; access to justice for low-income\, racialized\, and rural/remote communities; courts; and justice policy-makers. \nEvent details: \nDate/Time: Monday\, October 23\, 2023\, 5:00-6:00 pm EST (Toronto) \nPrice: Free \nWhere: Virtual (registration is required) \nRegistration: Eventbrite \nRegister Here \nFor related inquiries or more information about LCO projects\, please contact Noor at lawcommission@lco-cdo.org.

SUMMARY:Tax & Estate Planning Issues for New Canadians
DESCRIPTION:Live webinar with chat*\nincludes 60 day replay\n9:00 am – 10:30 am (Pacific)\n10:00 am – 11:30 am (Mountain)\n11:00 am – 12:30 pm (Central)\n12:00 pm – 1:30 pm (Eastern)\n1:00 pm – 2:30 pm (Atlantic)\n1:30 pm – 3:00 pm (Newfoundland) \n*This program features real-time audio of the presenter with synchronized presentation slides\, and a chat feature that allows for live Q & A. SK attendees please verify whether you align with Central (MB) or Mountain (AB) time based on season and location. \n\n\n\n\nWho Should Attend\nThis program will be of interest to lawyers whose practice includes wills\, estates\, trusts or tax planning\, as well as general practitioners. \n\n\nAbout the Program\nThe Canadian government plans to admit nearly 1.5 million new permanent residents over the next three years. This influx of newcomers will translate into more clients looking for information about how they will be taxed in Canada and how to maximize the wealth transferred to their heirs. With many of these individuals remaining tied to their families and to assets and structures in their countries of origin\, these are not topics most lawyers are equipped to answer. Especially for higher net worth individuals\, Canadian tax and estate planning raises complex issues; Canada’s tax laws are often unintuitive\, and Canada’s tax and estate or succession laws can also be incongruent with those of foreign jurisdictions. This presentation with experienced tax\, trusts and estate planning lawyer Rahul Sharma is designed to help non-tax specialists develop a working knowledge of Canada’s tax system so they can respond generally to recurring questions from new and prospective Canadian taxpayers. While the presentation will not make attendees competent to practice in this area\, it will allow attendees to meaningfully engage with clients and identify critical issues that require a co-ordinated plan. Sharing this advice early can avoid an estate being depleted by professional fees and reduce the risk of future negligence claims. Don’t miss this opportunity to help ensure the growing number of Canadian newcomers receive the tax and estate planning advice they need. \n\n\nMeet Your Presenter\n\nRahul Sharma is a Partner with Fasken. He advises international and Canadian clients on a variety of tax\, trust\, and estate planning matters\, in particular cross-border and international trust and estate matters\, and matters involving offshore or non-resident trusts with ties to Canada. Rahul also counsels high and ultra-high net worth individuals\, corporations\, trusts and estates on Canadian income tax matters\, including succession planning for closely held businesses. Rahul is recognized by Chambers and Partners as a leading lawyer in the area of private wealth law in Canada. Rahul is also recognized by Best Lawyers as a leading lawyer for trust and estate matters in Canada. Fluent in English\, French\, Spanish\, Hindi and Urdu\, Rahul regularly speaks on private client and tax topics and has authored and co-authored various chapters\, papers and articles on tax\, trust and estate-related matters. Rahul is the Editor-in-Chief of Federated Press’ Personal Tax and Estate Planning journal and a co-editor of Thomson Reuters’ Taxes and Wealth Management publication.

SUMMARY:Recentering Food Law and Policy: Connecting People and Place - 7th Canadian Association for Food Law and Policy Conference (Ontario)
DESCRIPTION:Canada is the second-largest country by total area\, with the world’s longest coastline.  Despite our vast size and geographical diversity\, our food systems remain deeply interconnected.  The food we produce and consume often travels long distances. In the process\, disruptions in supply chains\, labour shortages\, food safety concerns and extreme climate events in one area\, can have ripple effects near and far\, impacting how our food systems function as well as the availability and accessibility of food across the country. \nFor our 7th Canadian Association for Food Law and Policy conference – and our first above the 45th parallel – we will explore questions of interconnectedness in food systems. We will do so by decentering and recentering ourselves. More specifically\, we will explore how interconnections may be experienced differently when examined from different perspectives and vantage points.  For example\, what can we learn about the state of our food systems and our modes of governance by foregrounding northern\, rural\, remote and Indigenous communities in our analysis?  How can a deeper understanding of Indigenous food systems\, laws and governance as well as their relationship to Canadian law inform our work? How do our relationships with the natural environment impact food systems\, and conversely how do our relationships with food impact the natural environment? \nHosted by Bora Laskin Faculty of Law\, this year’s conference will bring together scholars\, practitioners\, policymakers\, students\, community advocates and stakeholders from across the country for collective learning\, conversations\, connection and more. Possible topics of discussion could include\, but are not limited to: \n\n\nGoverning supply chains in an era of multiple and ongoing crises (from labour shortages\, to international conflicts\, to pandemics etc.) \n\n\nAdapting food safety regulations to respond to sustainability demands\, human health concerns and technological innovations \n\n\nNavigating pressing issues in agriculture law and policy\, including sustainable production\, big data\, farmland inequality\, consolidation and farmer succession planning \n\n\n\n\nTensions between harvesting and safeguarding fisheries \n\n\nThe impact of international trade and investment agreements – as well as Canada’s trade policies – in shaping food systems domestically and abroad \n\n\nThe role of northern urban centers\, like Thunder Bay\, in governing and participating in local\, regional and national food systems \n\n\nThe legal challenges and opportunities facing Indigenous\, northern\, rural and remote food systems\, as well as food systems actors\, such as producers and harvesters\, hunters and fishers\, producers\, entrepreneurs\, processors\, retailers and eaters \n\n\nThe intersections between food systems and human rights\, particularly the rights of Indigenous Peoples

SUMMARY:Civil Litigation Basics 2023
DESCRIPTION:Who should attend: Junior civil litigators and experienced litigators seeking a refresher on key elements within civil litigation \nLearning level: Fundamental \nHere is a chance to experience top litigators presenting actual arguments to actual judges. This unique course is designed for several groups\, including: lawyers in the first two years of practice\, lawyers changing areas of practice\, and experienced lawyers who want a conceptual refresher on key elements within civil litigation. The program will also be of interest to law students and articled students. \nLaunched in 2021 as a Zoom webinar\, this innovative program takes a new approach\, as registrants will experience the entire life cycle of a case by watching counsel present the necessary arguments at various stages of a single fact pattern. \nThe first time through their presentation\, counsel will be making all the mistakes that drive judges crazy. Participants will try to identify all those errors in real time\, then listen as the judges and counsel debrief on what should have been done better. Counsel will then re-present the argument in the most effective manner. \nRegistrants will have an opportunity to test their skills against those of their colleagues\, as prizes will be awarded to those who can identify the most errors. This course will focus on providing registrants with the knowledge base they need to avoid falling into error themselves. \nPlease note: the practice-focused course materials will relate to the fact pattern\, the analysis of issues\, and error identification within each stage of the litigation process. Registrants seeking a topic-by-topic review of the elements of civil litigation are directed to CLEBC’s Courses on Demand archive of Civil Litigation Basics 2018 and the associated reference materials. \nLaw Society of BC CPD Hours: 9 hours (this course will contain a minimum of 2 hours pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management) \nCourse Chairs\nThe Honourable Mr. Justice Ward K. Branch — Supreme Court of BC\, Vancouver\nLuciana P. Brasil — Branch MacMaster LLP\, Vancouver

SUMMARY:Indigenous Data Sovereignty and Data Governance
DESCRIPTION:This meeting will be held virtually with no in-person component and will not be recorded. Instructions on how to view this webinar will be sent to registrants upon registration and 1-2 days prior to the meeting. If registration is closed or you have any questions\, please email knowledgenet@iapp.org.\n\n\n\n\nThis is a special joint event with the Calgary\, Edmonton\, Montréal\, St. John’s\, Toronto\, Vancouver and Victoria KnowledgeNet Chapters. \nTopic \nIndigenous Data Sovereignty and Data Governance \nIn her interim report titled “Sacred Responsibility: Searching for the Missing Children and Unmarked Burials”\, the Special Interlocutor identified 12 areas of common concern that created barriers to the recovery efforts to find the missing children and unmarked burials related to Indian Residential Schools. One of these areas was the need to affirm Indigenous Data Sovereignty. This was in addition to barriers caused by privacy laws developed or implemented without consulting Indigenous peoples. She urged Canadians not to be bystanders in the effort to overcome these barriers. \nWhat is Indigenous Data Sovereignty and how is it relevant to privacy? What does “not being a bystander” mean for privacy professionals and the role we play to ensure these rights\, which are enshrined in the UN Declaration on the Rights of Indigenous People\, are respected? \nIndigenous Data Sovereignty is the right of Indigenous people to own and govern data about their communities. It means Indigenous peoples are the stewards of data collection and the research done using their data. The inherent right to ownership\, control\, access and possession of Indigenous data triggers the obligation to obtain free\, prior and informed consent of Indigenous people’s to use of their data. \nAttendees will come away with key understanding on the complex history\, current context\, needs\, and the importance of establishing data governance processes that respect Indigenous Data Sovereignty. \nThank you to TD Bank for providing the virtual platform. \nSpeaker: \nGwen Phillips\, BC First Nations Data Governance Initiative Champion\, Ktunaxa Nation \nModerator: \nAbigail Dubiniecki\, CIPP/E\, CIPM\, Privacy Lawyer and Consultant \nTime: \n14:00-15:00 EST

Their services can be invaluable in achieving an early resolution or strengthening the case for trial in employment investigations\, criminal cases\, family law matters\, insurance claims\, and commercial disputes. This program with experienced labour and employment lawyers Michael Sherrard and Brian Wasyliw will address the legal and ethical issues that arise when lawyers retain private investigators and best practices to help investigators and instructing lawyers stay within the lines of permissible conduct and avoid potential pitfalls. By following some basic do’s and don’ts\, lawyers can ensure they obtain high quality\, admissible evidence that advances their case\, without compromising their professional and ethical standards.
