DESCRIPTION:Challenges often arise in accommodating employees with conditions that cannot be identified by a clear diagnostic test or that are not yet well-understood within the medical community. In this session\, experts will address these challenges\, answering questions including: \n\nWhat are common medical conditions that elude diagnosis\, or that are considered “diagnoses of exclusion”? Why does “long COVID” fall within that list?\nIs a definitive diagnosis\, or “objective evidence\,” necessary to establish disability? How should employers and unions respond where there is a lack of available medical practitioners with the requisite knowledge or experience to assess and attest to the condition?\nHow can employers and unions effectively formulate requests for medical information where an employee’s condition cannot be confirmed using a clinician’s diagnostic test?\nWhen sick leave abuse is a concern\, how can an employer distinguish between employees who have genuine\, difficult-to-diagnose disabilities\, and employees who are feigning illness? He developed extensive commercial interests in Greenspond\, Bonavista and on the Petit Nord generally. He was an effective proponent for legal reform in the period following 1715 and was appointed Chief Magistrate at St. John’s in 1729 and a Commissioner of the Court of Oyer & Terminer in 1750. The presentation will focus on the time period 1750 – 1754 and the trial of serious felony offences in Newfoundland in this period\, including trials for: murder\, rape\, assault causing grievous bodily harm and break\, enter & theft. \nBiographical Note: Christopher P. Curran. K.C. has had an extensive career in public service in Newfoundland and Labrador. He held positions as Deputy Minister of Justice\, Registrar of the Supreme Court\, and High Sheriff of Newfoundland. He retired from public service in 2012. RCIC \nLynn is a Regulated Canadian Immigration Consultant (RCIC) who operated her own business as a sole practitioner in Calgary\, AB for 17 years from 2004-2021\, is now semi-retired in Nanaimo\, BC. Her practice areas spanned a broad spectrum of immigration and refugee applications with a focus on Permanent Resident applications and criminal inadmissibility issues. She also has decades of experience in adult education – teaching\, writing and developing instructional materials such as the Immigration Practitioner’s Handbook published annually by Thomson Carswell Ltd. from 2006-2012. \nLynn is currently an Adjunct Professor in the Faculty of Law at Queens University teaching in the Graduate Program in Immigration and Citizenship Law [GDipICL]. She has taught the Ethics and Professional Responsibility Course for the Program since its inception and has also served as the Coordinating Instructor with responsibility for the curriculum. \nShe has a B.A. in Communications from Simon Fraser University and an LL.B. from the University of Victoria. She is a licensee in good standing of the College of Immigration and Citizenship Consultants (CICC) and a member of the Canadian Bar Association\, National Immigration Section.
