Starting with the common law bar on witnesses giving opinions\, we will examine the expert opinion exception. You’ll gain insights into the qualification of experts\, the White Burgess test for admissibility\, and how the law deals with expert bias. As we explore hearsay exceptions (including the “principled exception”)\, you’ll gain a firm grasp of how this intricate web of rules operates. Currie\, K.C. is Distinguished Research Professor at the Schulich School of Law\, Dalhousie University\, where his teaching areas include: evidence; Canadian\, international & cross-border criminal law; civil procedure; international law; and advocacy. He is a member in good standing of the Nova Scotia Barristers Society and has appeared as counsel at all levels of court in Nova Scotia\, as well as the Federal Court. He developed extensive commercial interests in Greenspond\, Bonavista and on the Petit Nord generally. He was an effective proponent for legal reform in the period following 1715 and was appointed Chief Magistrate at St. John’s in 1729 and a Commissioner of the Court of Oyer & Terminer in 1750. The presentation will focus on the time period 1750 – 1754 and the trial of serious felony offences in Newfoundland in this period\, including trials for: murder\, rape\, assault causing grievous bodily harm and break\, enter & theft. \nBiographical Note: Christopher P. Curran. K.C. has had an extensive career in public service in Newfoundland and Labrador. He held positions as Deputy Minister of Justice\, Registrar of the Supreme Court\, and High Sheriff of Newfoundland. He retired from public service in 2012. Prior programs\, each capped at 50 participants\, have generated a waiting list of qualified applicants. \nDiversity in the Courtroom Program \nThe College has long been committed to increasing its ranks of talented\, accomplished and diverse trial lawyers by including more women and persons of color\, varying ethnicities\, disabilities\, and sexual orientation.
