SUMMARY:Regulatory Offences and Criminal Prosecution 2024
DESCRIPTION:Understand the nuances of the regulatory regime/criminal law nexus! \nCan’t make the webinar or rebroadcasts?\nWant online CPD available 24/7?\n \nSubscribe to Courses On Demand\, our comprehensive online resource with 1\,500+ videos and 5\,400+ papers from CLEBC courses. This course will be added to Courses on Demand approximately 30 days from the original course date. \nWho should attend: Crown counsel\, defence counsel\, corporate solicitors\, civil litigators\, and in-house counsel at all levels \nLearning level: All levels \nRegulated industries are most often regulated by criminal\, quasi-criminal\, and administrative sanctions. However\, each enforcement branch requires counsel to practice in very different institutional and legal environments. \nOften\, defence counsel must defend persons accused of regulatory offences in parallel administrative proceedings. Conversely\, defence counsel assisting a client during an investigation\, review\, audit\, or other regulatory inquiry must be aware of when such a process might lead to a criminal or quasi-criminal prosecution. The practice is fraught with procedural\, legal\, and strategic peril. \nThis course will examine regulatory processes\, their operation\, and their implications for counsel who must handle proceedings in this dual-function context. The regulated industries covered in this program will include securities\, forestry\, mining\, environmental protection\, taxation\, and workplace safety\, among others. \nLaw Society of BC CPD Hours: 6 hours (this course will contain a minimum of 1 hour pertaining to professional responsibility and ethics\, client care and relations\, and/or practice management) \nCourse Chair\nChilwin Cheng — Ascendion Law\, Vancouver\n \n\n\n\n\n*Please note: The in-person session is dependent on a minimum number of registrants and may not be confirmed until 4 weeks before the course date. \nAre you a member of the Indigenous legal community (lawyer/Articled Student/legal support staff/paralegal) or a non-lawyer Indigenous community member?\nWe value your contributions and encourage your participation in all of our programs. To increase accessibility\, we offer a 50% discount* to all Indigenous lawyers/Articled Students/legal support staff/paralegals and a limited number of free online registrations to non-lawyer Indigenous community members (*discount applies to Regular prices\, not Early Bird prices). Please contact Customer Service to find out more. \nUnable to attend a course without financial assistance from CLEBC?\nClick here for bursary information. \nWant to register for a course now\, but prefer a monthly payment plan?\nCheck out our Easy Pay Plan. \nRegistration includes an electronic copy of the reference materials and lunch for in-person registration.\n\n\n\nCLEBC Program Lawyer*\nRaymond Lee\nrlee@cle.bc.ca\n*non-practising

SUMMARY:Can ADR transform a Society? The Jamaican Experience: Part 2 of 6 - Mediation Guest Lecture Series by the Commonwealth Lawyers Association
DESCRIPTION:Episode 1: “Mediators; Not Judges\, Not Arbitrators\, Not Decision makers. What\, really\, is mediation?” 19th September 2024 – Past Event \n  \nEpisode 2: “Can ADR transform a Society? The Jamaican Experience” 3rd October 2024\, 1pm BST\nJohn Bassie Register here\nThe various forms of ADR mechanisms are touching global societies and groups. Jamaica has been experiencing growth with ADR for over 30 years. This will provide a review of ADR’ s effect on the Youth\, communities\, the Legal system and Private Sector and a peak into the future expectations. \n  \nEpisode 3: “Mediation – The Changing face of Access to Justice” 17th October 2024\, 1pm BST\nRené M. Baptiste CMG Register here\nReferring different matters to Mediation is growing in importance allowing parties more freedom to be actively engaged in resolving their issues. Is it the alternative for Smaller States and their citizens? \n  \nEpisode 4: “Peace jurisprudence and constitutional reform- incorporating Mediation Principles into Supreme Law” 31st October 2024\, 1pm GMT\nJustice Vasheist V Kokaram JA Register here\nConstitutions must respond to developing norms of shared regional and international values of human rights and the rule of law. It is a visioning of a community of human beings collaborating to create an optimum environment for the celebration of our human dignity\, flourishing of our human potential\, sustainability of our human development and preservation of our species. But what all of our aspirations involved in constitutionalism cannot avoid is conflict which inevitably emerges in whatever political systems are designed. In my presentation I explore our baseline jurisprudential approach to the management of conflict and demonstrate the relevance of the DNA of mediation to develop new constitutional values and our instincts for peace. Can positive peace outcomes be achieved\, reinforced and sustained when we reorient our constitutional frameworks to a “meditative” and positive approach to conflict? What approaches to peacebuilding can be embedded within our task of constitutional reform to avoid conflict\, minimize its occurrence and harness its positive lessons? \n  \nEpisode 5: “Mediation Advocacy: The Ignored Middle Child?” 7th November 2024\, 1pm GMT\nGregory Vijayendran SC\nRegister here \nOpportunities abound these days to pursue a credentials and career as a mediator. As the “eldest child” in the room\, mediators guide\, facilitate\, nurture and set the agenda and pace of mediation. Clients new to mediation or relatively inexperienced are the “youngest child” who often need handholding and careful navigation about the process and practice of mediation. But what of the advocates themselves? Are they the proverbial “ignored middle children”? The speaker will touch on culture\, language\, ethos\, principles and best practices of mediation advocacy – a topic sometimes understated but mostly forgotten. He will contend that mediation advocacy plays a vital and overlooked role in mediation’s success \n  \nEpisode 6: “Interplay of Psychology\, Neuroscience and Conflict in Mediation” 14th November 2024\, 1pm GMT\nA. J. Jawad Register here\nMediation operates on a paradigm of conflict resolution unlike litigation or arbitration that operate on the paradigm of dispute adjudication. Mediation perceives conflict as a problem arising from the different perspectives and perceptions of the parties to the conflict and the emotions that get triggered due to such differing perceptions. It is therefore important for a mediator to understand these drivers of the conflict and move the parties to a position of understanding each others perspective. Therefore understanding the interplay of psychology\, neuroscience and conflict in mediation forms an integral part of mediation training.

But mishandled\, workplace investigations can leave companies and their investigators on precariously thin ice. From substantive problems like investigator bias to procedural flaws like failing to act quickly\, probes intended to provide answers can instead raise more questions\, undermine employment relationships\, and expose organizations to expensive litigation and public relations disasters. This program with experienced labour and employment law lawyer and workplace investigator Jackie Laviolette goes beyond the “how-to” of workplace investigations to address potentially fatal missteps in the investigation process and how to prevent them. Drawing on recent caselaw and with the help of relevant scenarios\, Jackie will share examples of common errors that compromise the actual or perceived quality of an investigation\, and practical strategies to avoid similar mistakes in investigations you’re involved with. By the end of the program\, you’ll better understand: \n\nWhat a fair\, defensible investigation looks like\nThe negative consequences of sloppy workplace investigations\nSpecific pitfalls that put an investigation\, or its investigator\, at risk\n\nDon’t miss this opportunity to learn how to anticipate and avoid the biggest blunders that undermine effective workplace investigations. \n\n\nMeet Your Presenter\n\nJackie Lavioletteis a Partner with Mathews\, Dinsdale & Clark LLP. Jackie has supported provincially and federally regulated employers in both the public and private sectors for over two decades. She has extensive experience with day-to-day matters in the areas of workplace conflict\, labour arbitration\, collective bargaining\, wrongful dismissals\, union certifications and policy development. Prior to joining Mathews\, Dinsdale & Clark LLP\, Jackie acted as in-house counsel for the largest unionized employer in Alberta and appeared as lead counsel before Boards of Arbitration\, Labour Boards\, human rights tribunals and all levels of Alberta courts. Jackie is frequently retained to conduct independent workplace investigations into allegations of workplace harassment\, discrimination\, and other employee complaints. She is a frequent speaker at various labour and employment conferences and seminars\, Jackie is listed in Best Lawyers in Canada for Labour and Employment Law.

SUMMARY:Mediation - The Changing face of Access to Justice: Part 3 of 6 - Mediation Guest Lecture Series by the Commonwealth Lawyers Association
DESCRIPTION:Episode 1: “Mediators; Not Judges\, Not Arbitrators\, Not Decision makers. What\, really\, is mediation?” 19th September 2024 – Past Event\nEpisode 2: “Can ADR transform a Society? The Jamaican Experience” 3rd October 2024 – Past Event \nEpisode 3: “Mediation – The Changing face of Access to Justice” 17th October 2024\, 1pm BST\nRené M.

SUMMARY:Invitation to the launch of Invisible Prisons with Lisa Moore & Jack Whalen
DESCRIPTION:From a review of the book: Invisible Prisons is an extraordinary\, empathetic collaboration between the magnificent writer Lisa Moore\, best-known for her award-winning fiction\, and a man named Jack Whalen\, who as a child was held for four years at a reform school for boys in St John’s\, where he suffered jaw-dropping abuses and deprivations. Despite the odds stacked against him\, he found love on the other side\, and managed to turn his life around as a husband and father. His daughter\, Brittany\, vowed at a young age to become a lawyer so that she could seek justice for him. Today\, that is exactly what she is doing—and Jack’s case is part of a lawsuit currently before the courts. \nThe story has parallels with Unholy Orders by Michael Harris about the Mount Cashel orphanage\, and with the many horrific stories about residential schools—all of which expose a paternalistic state causing harm and a larger society looking away. Yet two powerful qualities set this story apart. As much as it is about an abusive system preying on children\, it is also a tender tale of love between Jack and his wife Glennis\, who saw the good man inside a damaged person and believed in him. And it is written in a novelistic way by the great Lisa Moore\, who makes vividly real every moment and character in these pages. \nAuthors \nJACK WHALEN is the son\, brother\, husband\, and father whose story became this book. He divides his time between family homes in Oshawa\, Ontario\, and St. John’s\, Newfoundland. Recently\, he can sometimes be found crossing the country in a truck carrying a replica of the cell in which he was once imprisoned\, seeking justice for those who endured solitary confinement as children. \nLISA MOORE is the author of the bestselling novels Alligator\, February\, and Caught; the story collections Open and Something for Everyone; and a young adult novel\, Flannery. Her books have been finalists for the Commonwealth Writers’ Prize\, CBC Canada Reads\, the Writers’ Trust Fiction Prize\, the Scotiabank Giller Prize\, and the Man Booker Prize\, among many other honours and accolades. Lisa lives in St. John’s\, Newfoundland.
