SUMMARY:Parenting Coordination by the Family Dispute Resolution Institute Atlantic
DESCRIPTION:Online Zoom Presentation \n1 hour followed by 15 mins for further discussion with our presenter or FDRIA \nRecording will be available on demand the following the presentation \nRegister here \nABSTRACT This webinar is for family law professionals who work with parents experiencing significant conflict in co-parenting and implementing their parenting plan often resulting in continuous court motions.  \nWhen children are exposed to ongoing conflict between their parents\, they are at risk for social and mental health problems\, and may experience more difficulty with their own intimate relationships in the long term.  Parenting coordination can help to reduce parents’ conflict and may provide respite for children from exposure to their parents’ conflict. \nParenting coordination combines education\, coaching\, mediation and where necessary secondary arbitration to interpret the parenting plan related to day-to-day decisions. The Parenting Coordinator provides information\, effective tools and strategies for parents to improve their co-parent dynamic and communication to provide parents and children some respite from conflict. In some cases\, the role of the parenting coordinator is to disengage the parents completely. \nBorzou Tabrizi Borzou brings his years of family law experience to his work as a family mediator\, arbitrator and parenting coordinator. He has worked for many years with Toronto Family Mediation Service at Toronto’s Superior Court of Justice and Ontario Court of Justice\, helping high-conflict and distressed parties resolve difficult matters. \nBorzou is an affordable\, no-nonsense parenting coordinator\, with excellent experience arbitrating difficult matters and de-escalating emergencies. His clients appreciate his even-handed and compassionate approach\, even in the toughest cases. Borzou is a skilled and fair arbitrator when adjudication is required. \nFluently bilingual in Farsi and English\, Borzou brings a warm and tenacious approach to his work. He knows from experience that good faith negotiation can save families thousands of dollars in legal fees\, allow relationships to mend and achieve durable settlements that benefit families. \nAs a family lawyer running his own practice\, Borzou handles all family law matters with an emphasis on his top skill: negotiation and settlement. \nHe leads the Family Law Course at Riverdale and is a mediation coach for the York University Certificate in Family Mediation program.

But mishandled\, workplace investigations can leave companies and their investigators on precariously thin ice. From substantive problems like investigator bias to procedural flaws like failing to act quickly\, probes intended to provide answers can instead raise more questions\, undermine employment relationships\, and expose organizations to expensive litigation and public relations disasters. This program with experienced labour and employment law lawyer and workplace investigator Jackie Laviolette goes beyond the “how-to” of workplace investigations to address potentially fatal missteps in the investigation process and how to prevent them. Drawing on recent caselaw and with the help of relevant scenarios\, Jackie will share examples of common errors that compromise the actual or perceived quality of an investigation\, and practical strategies to avoid similar mistakes in investigations you’re involved with. By the end of the program\, you’ll better understand: \n\nWhat a fair\, defensible investigation looks like\nThe negative consequences of sloppy workplace investigations\nSpecific pitfalls that put an investigation\, or its investigator\, at risk\n\nDon’t miss this opportunity to learn how to anticipate and avoid the biggest blunders that undermine effective workplace investigations. \n\n\nMeet Your Presenter\n\nJackie Lavioletteis a Partner with Mathews\, Dinsdale & Clark LLP. Jackie has supported provincially and federally regulated employers in both the public and private sectors for over two decades. She has extensive experience with day-to-day matters in the areas of workplace conflict\, labour arbitration\, collective bargaining\, wrongful dismissals\, union certifications and policy development. Prior to joining Mathews\, Dinsdale & Clark LLP\, Jackie acted as in-house counsel for the largest unionized employer in Alberta and appeared as lead counsel before Boards of Arbitration\, Labour Boards\, human rights tribunals and all levels of Alberta courts. Jackie is frequently retained to conduct independent workplace investigations into allegations of workplace harassment\, discrimination\, and other employee complaints. She is a frequent speaker at various labour and employment conferences and seminars\, Jackie is listed in Best Lawyers in Canada for Labour and Employment Law.

SUMMARY:Mediation - The Changing face of Access to Justice: Part 3 of 6 - Mediation Guest Lecture Series by the Commonwealth Lawyers Association
DESCRIPTION:Episode 1: “Mediators; Not Judges\, Not Arbitrators\, Not Decision makers. What\, really\, is mediation?” 19th September 2024 – Past Event\nEpisode 2: “Can ADR transform a Society? The Jamaican Experience” 3rd October 2024 – Past Event \nEpisode 3: “Mediation – The Changing face of Access to Justice” 17th October 2024\, 1pm BST\nRené M. Baptiste CMG Register here\nReferring different matters to Mediation is growing in importance allowing parties more freedom to be actively engaged in resolving their issues. Is it the alternative for Smaller States and their citizens? \n  \nEpisode 4: “Peace jurisprudence and constitutional reform- incorporating Mediation Principles into Supreme Law” 31st October 2024\, 1pm GMT\nJustice Vasheist V Kokaram JA Register here\nConstitutions must respond to developing norms of shared regional and international values of human rights and the rule of law. It is a visioning of a community of human beings collaborating to create an optimum environment for the celebration of our human dignity\, flourishing of our human potential\, sustainability of our human development and preservation of our species. But what all of our aspirations involved in constitutionalism cannot avoid is conflict which inevitably emerges in whatever political systems are designed. In my presentation I explore our baseline jurisprudential approach to the management of conflict and demonstrate the relevance of the DNA of mediation to develop new constitutional values and our instincts for peace. Can positive peace outcomes be achieved\, reinforced and sustained when we reorient our constitutional frameworks to a “meditative” and positive approach to conflict? What approaches to peacebuilding can be embedded within our task of constitutional reform to avoid conflict\, minimize its occurrence and harness its positive lessons? \n  \nEpisode 5: “Mediation Advocacy: The Ignored Middle Child?” 7th November 2024\, 1pm GMT\nGregory Vijayendran SC\nRegister here \nOpportunities abound these days to pursue a credentials and career as a mediator. As the “eldest child” in the room\, mediators guide\, facilitate\, nurture and set the agenda and pace of mediation. Clients new to mediation or relatively inexperienced are the “youngest child” who often need handholding and careful navigation about the process and practice of mediation. But what of the advocates themselves? Are they the proverbial “ignored middle children”? The speaker will touch on culture\, language\, ethos\, principles and best practices of mediation advocacy – a topic sometimes understated but mostly forgotten. He will contend that mediation advocacy plays a vital and overlooked role in mediation’s success \n  \nEpisode 6: “Interplay of Psychology\, Neuroscience and Conflict in Mediation” 14th November 2024\, 1pm GMT\nA. J. Jawad Register here\nMediation operates on a paradigm of conflict resolution unlike litigation or arbitration that operate on the paradigm of dispute adjudication. Mediation perceives conflict as a problem arising from the different perspectives and perceptions of the parties to the conflict and the emotions that get triggered due to such differing perceptions. It is therefore important for a mediator to understand these drivers of the conflict and move the parties to a position of understanding each others perspective. Therefore understanding the interplay of psychology\, neuroscience and conflict in mediation forms an integral part of mediation training.

SUMMARY:Invitation to the launch of Invisible Prisons with Lisa Moore & Jack Whalen
DESCRIPTION:From a review of the book: Invisible Prisons is an extraordinary\, empathetic collaboration between the magnificent writer Lisa Moore\, best-known for her award-winning fiction\, and a man named Jack Whalen\, who as a child was held for four years at a reform school for boys in St John’s\, where he suffered jaw-dropping abuses and deprivations. Despite the odds stacked against him\, he found love on the other side\, and managed to turn his life around as a husband and father. His daughter\, Brittany\, vowed at a young age to become a lawyer so that she could seek justice for him. Today\, that is exactly what she is doing—and Jack’s case is part of a lawsuit currently before the courts. \nThe story has parallels with Unholy Orders by Michael Harris about the Mount Cashel orphanage\, and with the many horrific stories about residential schools—all of which expose a paternalistic state causing harm and a larger society looking away. Yet two powerful qualities set this story apart. As much as it is about an abusive system preying on children\, it is also a tender tale of love between Jack and his wife Glennis\, who saw the good man inside a damaged person and believed in him. And it is written in a novelistic way by the great Lisa Moore\, who makes vividly real every moment and character in these pages. \nAuthors \nJACK WHALEN is the son\, brother\, husband\, and father whose story became this book. He divides his time between family homes in Oshawa\, Ontario\, and St. John’s\, Newfoundland. Recently\, he can sometimes be found crossing the country in a truck carrying a replica of the cell in which he was once imprisoned\, seeking justice for those who endured solitary confinement as children. \nLISA MOORE is the author of the bestselling novels Alligator\, February\, and Caught; the story collections Open and Something for Everyone; and a young adult novel\, Flannery. Her books have been finalists for the Commonwealth Writers’ Prize\, CBC Canada Reads\, the Writers’ Trust Fiction Prize\, the Scotiabank Giller Prize\, and the Man Booker Prize\, among many other honours and accolades. Lisa lives in St. John’s\, Newfoundland.

However\, as with most legal issues\, there is no certainty that these contracts will be upheld. Judicial consideration has shown that domestic contracts are vulnerable to being set aside or varied in the future\, where equity can be argued. So\, what can drafting lawyers do to help ensure a testator’s wishes have the intended effected? This presentation by experienced wills and estates and family law mediator and litigator Gary Kirk will provide prophylactic steps to help ensure the integrity of domestic contracts and minimize the need to take remedial steps – the effectiveness of which is uncertain – or litigate the validity of a contract after the fact. By the end of the program\, you will better understand: \n\nthe factors that affect judicial consideration of domestic contracts and testamentary freedom\nthe risks of claims and court intervention\nfundamental safeguards that should accompany domestic contracts involving inheritance waivers\n\nYour clients’ confidence and certainty in their testamentary plans will increase if appropriate and prudent steps are taken when executing a domestic contract. Attend this program and learn what you can do to help preserve the function and intent of these contracts. \n\n\nMeet Your Presenter\n\nGary Kirk has been practicing law for more than 20 years and is the Managing Partner of Kirk Montoute Dawson LLP in Calgary\, Alberta. In addition to Mediation/Arbitration\, Wills & Estates and Family Law\, Gary is also an experienced litigator. Gary has appeared before all levels of court in Alberta. SUMMARY:Mediating High Conflict Disputes
DESCRIPTION:Limited enrolment for in-person registrations. Register early to avoid disappointment!\n\n\n\n\n\n\nPlease note: This course will not be added to Courses on Demand. Courses involving professional speakers and skills-based workshops generally do not get added to Courses on Demand. \nWho should attend: All mediators and those acting as counsel in mediations \nLearning level: Intermediate \nHave your best mediation skills failed with some clients? And then felt that despite your best efforts\, some mediations are impossible? \nIt’s likely that you may have been mediating with one or more parties with a high conflict personality\, making it a high conflict dispute. \nHigh conflict disputes are different. They often involve one or more individuals with a pattern of high conflict behaviour\, characterized by all-or-nothing thinking\, unmanaged emotions\, extreme behaviour\, and preoccupation with blaming others. \nIn this one-day workshop\, instructor Michael Lomax will provide a new approach to mediating such disputes: New Ways for Mediation. This approach includes several paradigm shifts from ordinary mediation by not relying on insight\, expression of emotions\, or discussions of the past. \nInstead\, this method focuses on teaching clients four simple skills to use within a simple structure that keeps them focused on problem-solving solutions and away from venting\, reworking the past\, extreme demands\, rigid positions\, and other self-defeating behaviours. \nThe skills for mediators are also simple and less stressful\, so that they serve primarily as a guide and source of information throughout the process. Some or all of the tips and tools of this method can be used with any mediation. \nAfter this training\, you will: \n\nhave the necessary skills for handling high conflict mediations\nexperience increased confidence as you settle into the specific structure of this method\nlet go of feeling responsible for the outcome\n\nPrerequisite: It is recommended that you have already taken some introductory training in Dealing with High Conflict Behaviours with Michael Lomax or the High Conflict Institute. \nCourse Instructor\nMichael J. SUMMARY:Peace jurisprudence and constitutional reform - incorporating Mediation Principles into Supreme Law
DESCRIPTION:The Commonwealth Lawyers Association invites you to join them for a mediation guest lecture series as episode 4 takes place with Justice Vasheist V Kokaram JA. \nRegister here to attend \nConstitutions must respond to developing norms of shared regional and international values of human rights and the rule of law. It is a visioning of a community of human beings collaborating to create an optimum environment for the celebration of our human dignity\, flourishing of our human potential\, sustainability of our human development and preservation of our specie. Can positive peace outcomes be achieved\, reinforced and sustained when we reorient our constitutional frameworks to a “mediative” and positive approach to conflict? What approaches to peacebuilding can be embedded within our task of constitutional reform to avoid conflict\, minimise its occurrence and harness its positive lessons? \nDate: 31st October 2024\n \nTIME: \n8.00 am Jamaica\n8.00 am The Bahamas\n9.00 am Dominica / Trinidad and Tobago / St Vincent and the Grenadines\n1.00 pm United Kingdom\n2.00 pm Nigeria\n3.00 pm Zambia\n6.30 pm India\n9.00 pm Singapore / Malaysia / Hong Kong\n11.00 pm PNG \nRegister here to attend \nPanelist \n\nJustice Vasheist V Kokaram JA\n\nEpisode 5 – 7th November –  Mediation Advocacy: The Ignored Middle Child?\nEpisode 6 – 14th November – Interplay of Psychology\, Neuroscience and Conflict in Mediation \n\n+ Google Calendar+ iCal Export\n\n\n\nOrganiser\n\nCommonwealth Lawyers Association

SUMMARY:Mediation & Arbitration
DESCRIPTION:COMPLEMENTARY PRESENTATION \nRegister Here \nA family dispute resolution service that provides for mediation to resolve concerns with the option to move to arbitration for concerns that are not settled. \nThis webinar is for family law professionals who are looking at family dispute resolution options for their practice and families. \nHear how Mediation Arbitration could be a practice option that grows your practice while providing families with options outside of court. Increasingly\, we are seeing professionals in the region who are offering FDR processes as part of the suite of services they offer clients. \nMediation-arbitration (med-arb) combines two FDR processes. In mediation\, the parties work with the mediator who helps them negotiate terms of a settlement. Any concerns not resolved through mediation\, continue through to arbitration where the trained arbitrator hears evidence from both of the parties and makes decisions in the form of an award. \nTom Dart was called to the bar in 1976.  In the early stages of his career\, he practiced as a criminal lawyer\, a civil litigation lawyer and a family law lawyer.  He now practices only in the area of family law and alternative dispute resolution. Tom is a Certified Specialist in Mediation (FDR Med) and Arbitration (FDR Arb).  Tom has appeared at all levels of Court in Ontario from the Ontario Superior Court of Justice to the Ontario Court of Appeal. He has conducted many trials and many successful negotiations. \nAs a Mediator\, Tom has assisted many mediation clients in resolving their disputes on a comprehensive basis – settling financial issues such as property division and support as well as parenting issues.  He actively promotes mediation as the means of resolving family law disputes with a non-adversarial approach. \nTom is an experienced Arbitrator of family law disputes\, appointed by parties who wish to resolve their disputes privately under the Arbitration Act.  Arbitration can prove an effective and cost-efficient method of resolving any family law dispute and Tom is committed to alternatives to dispute resolution such as this. \nTom is an active participant in the legal profession.  Tom has presented many topics at continuing legal education seminars for the Canadian Bar Association and the Law Society of Ontario (LSO).  He has written articles for presentation at such seminars and for other newsletters and periodicals in the area of family law.  He has been engaged as an expert witness for standard of care in family law cases.  Tom is a founding member of Family Dispute Resolution Institute of Ontario.  He is currently on committees to reform family law and the court system and is a Dispute Resolution Officer at Barrie Family Court.  He is the past president of the Family Law Section of the Ontario Bar Association\, past president of Family Mediation Canada\, past president of the Ontario Association for Family Mediation\, past vice-president of the Simcoe County Lawyers’ Association\, past president of the Simcoe County Family Law Lawyers’ Association and past coordinator for Simcoe County’s Dispute Resolution Officers Program. \nTom received the OBA Award for Excellence in Family Law in Memory of James G.
