From 2000 to 2005\, he served as Executive Vice-President\, President\, and General Counsel for Guigné International Limited. \nChief Justice Whalen was appointed as a puisne judge of the Supreme Court of Newfoundland and Labrador\, Trial Division\, in 2008 for the Judicial Centre of Gander\, later transferring to St. John’s in 2014. On December 11\, 2014\, Justice Whalen was appointed Chief Justice of the Supreme Court of Newfoundland and Labrador\, where he continues to provide leadership and guidance in the administration of justice. \nJohn Brooks\, KC \nJohn Brooks\, KC\, is a distinguished criminal law practitioner based in St. John’s\, Newfoundland and Labrador. He earned his LLB from the University of New Brunswick in 1978\, was called to the Bar of Newfoundland and Labrador in 1979\, and was appointed King’s Counsel in 2002. John brings over 42 years of experience to the legal profession. DESCRIPTION:Critical incidents are situations that occur outside of our normal frame of reference and challenge us to understand and cope with what has happened. Critical Incident Group Debriefing (CIGD) is a short-term group intervention process that focuses on an immediate event. CIGD is one of several methods that may be utilized to lessen the likelihood of people experiencing symptoms of trauma and stress after a critical incident. This group debriefing process provides a place for participants to talk and share experiences\, and for the facilitator to teach and provide information about the impact of critical incidents. DESCRIPTION:Seminar Overview           \n This seminar will provide insights into becoming and being a neutral decision maker from an administrative law perspective. \nThere is no single road map for lawyers who want to become a neutral decision-maker or an independent adjudicator. Being a neutral is an uncertain and unfamiliar role for many lawyers. This CLE seminar will provide attendees with insights into how lawyers become neutral adjudicators and what it is like to act in a neutral role. This seminar will use a panel discussion format with the presenters responding to various questions from the moderator. The topics to be canvassed will include: \n\nWhy and how a lawyer becomes a neutral decision-maker;\nHow becoming a neutral changes a lawyer’s career path;\nThe positives and negatives of being a neutral as opposed to an advocate;\nThe “dos” and “don’ts” for lawyers who appear before neutral decision-makers; and\nWhat writing decisions is like\, particularly when facing appellate/judicial review.\n\nIn-person attendance is strongly encouraged where possible. SUMMARY:Recent Developments in the Law of Damages and Injunctions
DESCRIPTION:Live Event Time: 12:00 PM ET\nHosted by Thomson Reuters\n\n\n\n\nThe last few years have been busy ones for developments in injunctions law and have generated important new decisions on the jurisdiction to grant injunctions\, injunctions in relation to homeless encampments and occupation protests\, interlocutory injunctions in Charter cases\, and interlocutory injunctions in defamation cases. The leading Canadian authority on injunctions and equitable remedies\, the Honourable Robert J. Sharpe\, discusses these developments both in domestic Canadian law and internationally.\n\n2023 and 2024 have also seen significant new decisions on the law of damages\, including the confirmation by the Supreme Court of Canada that the state is liable for damages when legislation is clearly unconstitutional at the time of enactment or is enacted by the state in bad faith or as an abuse of power. In terms of private law damages\, there have been some remarkably high awards recently\, including a punitive damages award of $1\,500\,000 in Ontario which had an emphatically deterrent function\, and a massive trial award of $10\,125\,000 in British Columbia for the tort of misfeasance in public office. These developments are discussed by Patrick Healy\, a commercial litigator in Toronto\, who is the new author of The Law of Damages in succession to the late Professor Stephen Waddams.\n\nBusy at this time? He retired from the judiciary in 2020 after serving for 25 years as a judge. He was a professor at the Faculty of Law\, University of Toronto from 1976 to 1988 and Dean from 1990 to 1995. Robert Sharpe is a Fellow of the Royal Society of Canada\, and an Officer of the Order of Canada. Justice Sharpe is the author of Injunctions and Specific Performance\, part of Westlaw’s Topical Texts and Annotations.\n\n\n\n\n\n\n\nPatrick Healy\nCounsel and Litigation Lawyer\nWeintraub Huang LLP\n\n\n\n\nPatrick Healy holds a Ph.D. in Medieval History from Trinity College Dublin and taught history at Trinity and at St. Hugh’s College\, Oxford. Engaging in making reconciliation real as a settler-Canadian is a priority in her work. \nChief Mi’sel Joe\nTraditional Chief Mi’sel Joe (Cultural Advisor) was Administrative Chief of Miawpukek Mi’kamawey Mawi’omi First Nation\, NL\, for over three decades. In this role\, he has been instrumental in transforming NL’s understanding of Indigenous Leadership and guided Conne River to becoming a successful and thriving community. Since his retirement in 2024\, he serves as Traditional Saqamaw with a commitment to preserving the language\, culture\, and traditions of his people. He has been a mentor and guide for RFNL since 2018. \nTisia Procopio Stemp\nTisia Procopio Stemp (Doctoral student\, RFNL Community/Justice Coordinator) has an extensive background in justice education\, having worked with local policy leaders and educators across the globe to develop and initiate arts-and-culture-based programming in schools and community learning spaces. Tisia’s work focuses on designing and implementing culturally sustainable teaching and learning experiences and decolonizing approaches to broaden the scope and integration of restorative and transformative justice education. \nSarah McDonald Moores\nSarah McDonald Moores (RFNL Education Coordinator) is a graduate of Memorial University’s Bachelor of Music/Bachelor of Music Education and Master of Education: Educational Leadership Studies Programs. She now practises law in her home province of Newfoundland and Labrador\, working exclusively in wills\, estates\, probate\, elder law\, and trusts. Lynne has been interviewed by Global TV\, BNN\, CBC Radio\, the Wall Street Journal\, the Globe & Mail\, the Vancouver Province\, the Edmonton Journal\, the Toronto Star and the Montreal Gazette\, among other media. She is the former co-host of The Law Show and is the author of ten books about estate planning.
