Amendments to the Automobile Insurance Act
Please note that there have been amendments to the Automobile Insurance Act [RSNL 1999, c. A-22] (the “Act”) as outlined in An Act to Amend the Automobile Insurance Act. Please follow the below link to review the amendments:
We highlight, in particular, the addition of s. 25.1 to the Act which, among other things, requires a person intending to commence an action for loss or damage from bodily injury or death arising directly or indirectly from the use or operation of a motor vehicle to:
a) serve written notice of the intention to commence an action on the insured within 120 days after the accident [emphasis added].
In order to prevent potential claims and/or complaints, members are encouraged to diarize the additional notice requirements appropriately.
