Amendment to Law Society Rule 18 and Law Society Form 18

It has been brought to our attention that the requirement to append Law Society Form 18 to documents witnessed, commissioned or notarized in accordance with the Temporary Alternate Witnessing of Documents Act may cause some confusion as to whether the Form must also be filed with those documents.

To remove any ambiguity, we have amended Law Society Rule 18 and Law Society Form 18 to remove this requirement. Members are still required to: i) maintain the Form in the client’s file; and ii) provide the client with a copy of the Form.

If any member has appended the Form to a document that has already been filed, you may wish to consider requesting the return of the Form as it may contain your client’s personal and/or solicitor-client privileged information.
