The new Divorce Act has a list of factors to help family lawyers, dispute resolution professionals, and the courts determine what is best for your child in your particular situation.
One of these factors is a child’s views and preferences. Hear the Child is an approach to obtaining the views of a child through a trained neutral child interviewer. The child interviewers meet with children and prepare a report that contains the child’s verbatim views so that their views can be considered by adults making decisions about the child’s best interests in a family justice process such as a mediation or court case. The interviewers do not assess the child nor the parents.
