Preparing and Dealing with Expert Witnesses

January 30, 2023 @ 8:00 am - 5:00 pm

Many complex cases are determined by the testimony of an expert witness.

Even experienced lawyers may find it intimidating to examine an expert witness. Expert witnesses have a high level of proficiency and knowledge in their areas that litigators may find challenging to work with or overcome. Our faculty who are senior members of the bench and bar will provide individualized feedback, and help you apply techniques on how to expertly examine the expert.

This hands-on and advanced program will help you apply the most effective strategies in dealing with expert witnesses – both on your side and the opposing side.  You will also have the opportunity to practice how to properly prepare witnesses for examination.

You will also learn how to maximize your witness preparation time and efforts. Witness preparation is key to successful litigation, and in these times of remote trials, you will need to employ the best strategies that will make a difference in the real and the virtual courtroom.

What you’ll learn through a combination of discussions and learn-by-doing exercises

  • Practical tips for planning your examination strategy
  • Best practices for working with your expert witness to produce the expert report
  • How to conduct effective direct and re-examinations
  • Cross examinations – how to best attack the opposing experts’ report
  • Exhibits at trial: how to introduce diagrams, photographs, real objects and documents
  • Utilizing technology to produce effective exhibits online
  • Practical strategies for examining expert witnesses in the virtual courtroom
