Preparing for and Advocacy at Mediation: A Mediator’s Perspective for Lawyers by the Toronto Lawyers Associaton

Mediation presents a critical opportunity in the life of litigation.

The degree to which you and your client are prepared can impact your chances of reaching a settlement that maximizes your client’s interests. This CPD will touch on risk analysis, pre-mediation conferences, content of mediation briefs, practical considerations for multi-party cases, and the underlying interests of the parties as important things to consider before your mediation.

Advocacy at mediation can also impact the outcome – but advocacy at mediation is different than advocacy at trial. This CPD will address mediation advocacy, mediator strategies and styles and how you can create value for your client at mediation even where no settlement is reached.


Jennifer Egsgard, Egsgard Mediation

Called to the bar in 2002, Jennifer Egsgard has been mediating contract, commercial, insurance, employment, personal injury, product liability and other disputes since 2018.
