The Complaints Authorization Committee counselled a member that the failure to respond to another member’s correspondence and to communicate to the member the requirement for personal service does not comply with the standard of conduct contemplated by Chapter XVI, commentaries 3 and 6 of the Code of Professional Conduct.

Cautions

The Complaints Authorization Committee cautioned a member that the member’s failure to return documents that had been provided to the member in escrow does not comply with the standard of conduct contemplated by the Code of Professional Conduct, Chapter XVI, rule and commentary 6.

The Complaints Authorization Committee cautioned a member that the member’s failure to file an Affidavit on behalf of the member’s client and the failure to receive notice of a case management meeting does not comply with the standard of conduct contemplated by the Code of Professional Conduct, Chapter II, and in particular rule (b) and commentary 7 thereof.

The Complaints Authorization Committee cautioned a member that direct communication with a party represented by another solicitor without consent of the other solicitor, does not comply with the standard of conduct contemplated by the Code of Professional Conduct, Chapter XVI, and in particular commentary 8 thereof, which prescribes in part: The lawyer should not communicate upon or attempt to negotiate or compromise a matter directly with any party who is represented by a lawyer except through or with the consent of that lawyer.

The Complaints Authorization Committee cautioned a member that the member=s absolute failure to respond to the Law Society, during the investigation of a separate allegation, does not comply with the standard contemplated by the Law Society Rules and in particular rule 9.04(3) and 9.07(1) and the Code of Professional Conduct, Chapter XV, commentary 2.
