Gladue Reports in Nova Scotia: A Case Study

Seminar Overview
Gladue Reports were first produced in 2001 by Aboriginal Legal Services in Ontario. Since that time, Gladue Reports have become accepted by the courts in Nova Scotia, Québec, Ontario, Alberta, British Columbia, and the Yukon. In the other provinces and territories – including Newfoundland and Labrador – Gladue reports are very rare.

This seminar, which is the third in our series, is being facilitated by the Mi’kmaw Legal Support Network, which is the organization responsible for the delivery of Gladue services in Nova Scotia courts. Our presenters will provide an overview of the Gladue Report process as it has unfolded in their province. Learn about the Gladue decision, Galdue factors, and the importance of utilizing Gladue Reports during bail and sentencing hearings. We will also review and discuss relevant issues related to colonialism and systemic discrimination.

Mona O’Brien
Mona has a passion for assisting vulnerable people in her role as an Indigenous Court Worker with Mi’kmaw Legal Support Network. This role allows her to facilitate a greater understanding between the criminal justice system and Indigenous offenders and creates an opportunity to provide a bridge between the justice system and the community. Mona has been a Gladue Writer with Mi’kmaw Legal Support Network since 2013. She is a member of the National Directors for Indigenous Court Workers as well as various provincial committees in Nova Scotia. Originally from rural Newfoundland and Labrador, Mona now makes her home in Truro, Nova Scotia. She was an active volunteer with the local Army Cadet Corp in Truro, Nova Scotia from 2016 to 2020 and is a past Lions Club International member.

Shannon Googoo
Shannon’s career has always been focused on helping others. She started working with the Mi’kmaw Legal Support Network in 2016 as a Gladue Writer before taking on the role of Gladue Coordinator in December 2017 where she works hand in hand with Indigenous court workers and the court’s administrative staff. Her previous experience as a Gladue writer allows her to understand the role of the Gladue writing process and what it entails. She is a great listener and offers support to all, which includes the clients and justice system stakeholders.
