Drawing on his book Judicializing Everything? The Clash of Constitutionalisms in Canada, New Zealand, and the United Kingdom, Professor Harding will examine the rise of judicial power in Canada and other Westminster democracies. The lecture will explore how political questions become legal and constitutional ones, how the Charter of Rights and Freedoms accelerated this process, and why debates about the proper roles of courts and legislatures persist. It will also consider how this development has expanded the reach of constitutional law into ever more areas of political and social life.
