Amendments to the Lands’ Act
We have just been advised that amendments to the Lands’ Act have received Royal Assent. A link to the Bill is below.
While there have been changes which may help to streamline processes, regrettably, despite contrary input during the original review process from members of the Law Society; despite the different assertions made publicly last fall that it would be amended to permit evidence of possession for a 20 year period up to 2007 for property located in municipalities and 30 years for all other property; and, without any further input from the Law Society, the government has decided to incorporate the principles outlined in the Court of Appeal decision in Ring which require open, continuous, notorious and exclusive possession for 20 years immediately prior to 1 January 1977.
