B.C. Supreme Court Grants Federation Injunction Application
The Federation’s request for an injunction, seeking to halt the enforcement of the recently extended mandatory disclosure provisions in the Income Tax Act concerning members of the legal profession, has been approved by the Supreme Court of British Columbia. The hearing for the injunction took place on October 20, 2023, and a temporary injunction, initially set to expire on December 1, 2023, was granted.
In a decision issued on November 24, 2023, members of the legal profession, including notaries in Quebec, have been granted an exemption from the new reporting requirements that came into effect in June. This exemption will remain in place until the conclusion of the Federation’s constitutional challenge against those amendments.
