NOTICE TO THE PROFESSION
APPLICATIONS PURSUANT TO THE ADULT PROTECTION ACT, 2021
Please be advised that documents in all matters in St. John’s pursuant to the Adult Protection Act, 2021, SNL 2021, c A-4.02 (the “APA”), will be issued out of the General Division (Probate Registry) effective immediately. Counsel commencing proceedings under the APA are not required to file originating documents in Family Division and are instead requested to attend the Probate Registry on Duckworth Street for all adult protection matters on a prospective basis. There will be no change in practice in other judicial centres.
APA matters will still be assigned Family Division file numbers, and they will proceed in accordance with the Supreme Court Family Rules.
