NOTICE TO THE PROFESSION AND GENERAL PUBLIC – COURT OF APPEAL OPERATIONS

COURT OF APPEAL OF NEWFOUNDLAND AND LABRADOR

Upon the passing of Her Majesty Queen Elizabeth II on Sept. 8, 2022, the Court of Appeal of Newfoundland and Labrador is providing the following Notice.

Any reference to Her Majesty the Queen in the Court of Appeal Rules, whether criminal or civil, and the accompanying forms, is hereby changed to His Majesty the King. Parties are expected to designate His Majesty the King rather than Her Majesty the Queen in any new filing where the Crown is a party. With respect to matters commenced prior to Sept 8, 2022, the designation of the Crown will be considered to have been so altered without the need to bring a motion before the court to amend the style of cause.

Documents subsequently filed in such matters should bear the amended title of the proceeding.

The Queen’s Counsel bench in the Court of Appeal Courtroom is now referred to as the King’s Counsel bench since Queen’s Counsel appointees now use the title of King’s Counsel.

Any reference to Her Majesty the Queen in the wording of statutory oaths sworn in the Court of Appeal of Newfoundland and Labrador are replaced with reference to His Majesty the King.

The Court of Appeal will be closed on September 19, 2022 in observance of a Day to Honour Queen Elizabeth II.
