Purpose
The Muskrat Falls Project Land Use and Expropriation – Arbitration Panel (the Panel) determines compensation related to land expropriations under the Muskrat Falls Project Land Use and Expropriation Act. In accordance with Section 24 of the Act and Section 16 of the Regulations, the Panel arbitrates disputes over compensation for former landowners affected by the Muskrat Falls Project. The Panel primarily serves Newfoundland and Labrador Hydro, Emera Newfoundland and Labrador, and affected landowners.
Structure
The Panel comprises ten members, including the Chairperson and Vice-Chairperson, who also serve as arbitration panel members. Members are selected through a merit-based process as a Tier 2 entity under Schedule C of the Public Service Commission Act.
Operation of the Arbitration Panel and Tribunals
- The arbitration panel governs its own procedures.
- The Chairperson appoints arbitration tribunals from among the panel members to conduct hearings on compensation matters.
- Tribunals must include either the Chairperson or Vice-Chairperson.
- Tribunals may conduct hearings concurrently.
- Tribunals have powers equivalent to commissions under the Public Inquiries Act, 2006.
- Tribunal decisions are considered decisions of the arbitration panel.
Competency Profile
- The Chair and Vice-Chair must be members in good standing under the Law Society Act, 1999.
- Other members are not required to be lawyers but must have:
- Knowledge of relevant legislation and regulations.
- Ethical standards and integrity.
- Strategic thinking and collaborative skills.
- A pan-provincial perspective, not individual or organizational priorities.
- Expertise in law, governance, regulation, financial management, or dispute resolution.
Time Commitments
Members must attend quarterly meetings or more frequently as determined by the Chair. Additional time may be required for preparation and working group participation.
Term
Members serve three-year terms and may be reappointed.
